    Now as an O/O i pay whats known as Occupational/Accidental (a different version of workers comp) and if your hired on as a company driver you should not be paying any workers comp. my other question is why do they have you doing a 1099??? did you sign a contract of some sorts stating your a contract driver???

    Walk, do not go to work for them. They should have stollen the brake drums also, those cost good muney.

    The 1099/W-2 thing alone is going to get this company in a lot of trouble. if he's not truly a 'contractor', he can't be 1099. He's a person, using their equipment, that has no control over his work. The FMCSA/DOT has already made specific who can/can't be paid 1099. And he's not a contractor. Whether he signed a contract or not. Otherwise, McDonald's would sign a 'contract' with every burger flipper to avoid OSHA/Fair Labor laws. They're not allowed to.

    But, again, get a lawyer. Tomorrow morning. Do not talk to your 'company'. If they contact you, give them the phone number of your lawyer and they can talk to them.

    Heh what happened today, nothing good! Well, i called him about 3-4 times he finally made some time for me. Our conversation started by him saying how he will work with me and that he will help me out by setting up a payment option i just kept listening what he had to say. He sounded like someone from home shopping network "we can set u up on 14 easy payments of $300" he didnt say "easy" but it sure sounded like that! I mean this is just insane! Once he said that i had to stop him. It was my time to speak. i told him i am not willing to pay for something that insurance will cover and for something that should be paid by the company for doing business and this is a part of a risk taken by doing business. . I told him everything i learned over the weekend here and elsewhere but mainly here, and how he is not allowed to charge me not only for the full amount of $4200 but not even the insurance deductable and check this out, NOW it's $2500 not $1500 like it was a week ago. I was getting really frustrated, i asked him why does he have me and rest of the employees on 1099 and about works comp i also asked him does he realize what he is doing is illegal. I capt asking him about my paycheck that i still havent received it, not only my paycheck but they are yet to send me my statements. He sounded surprized about me questioning him and asking for answers. Our conversation got deep i even mentioned getting lawyers involved as well as the labor board for not paying me miles i drove. I had so much more to say and demand every dollar i earned when he interrupted me with an apology and said "i am very sorry, let me please call you right back something had happened and it demands my attention immediately"

    AS you probabaly can guess, he never called me back. I tried calling him about half a dozen times on his personal cell phone to no avail.
    I am getting tired of this run around and trying to screw me on every corner, i have decided its time to move on. I will do whatever it takes to get my money back! I am still debating if i should be an real Ahole and report to him to the proper authorities for the handling of the business and its employees the way they do.
    As for me, it looks like i found a new company to call home.

    I have a scheduled meeting with my atorney tomorrow to see how we should go about handling this case. I do insist of getting all of my money back, including: paychecks, deposits and all of the money paid for works comp as well handing of taxes do to 1099 fraud. Depending of what my attorney says, i would like to include rest of the employees regarding the works comp and 1099 situation.

    I will try to keep you guys updated of the outcome!

    Thank you all for your help, support and making me open my eyes as i was blind to what was going on!

    When it is all over they will have to pay back their part of SS for every driver they have paid on a 1099. Be sure and check your DAC when this is over, if they screw it up, hit them again.

    DON'T give up. Your on the right track. You should of call labor board so they could your money right away, then the attorney.
