Is it unlawful or illegal to enter sleeper berth without a post-trip inspection first? Where can I find the legal stat for this in the book where it says that you must first have a post trip before going to sleep?

The regs say you must complete a post trip inspection report. They say nothing about an inspection. Some carriers require that you do an inspection, and may require that you use a specific amount of time for that - but that's between you and your carrier. If they don't, its permissible to just flag the time that you completed the report, and note that you did it followed by going to line 1 or 2.
§ 396.11Driver vehicle inspection report(s). (a) Report required. (1) Motor carriers.Every motor carrier shall require its drivers to report, and every driver shall prepare a report in writing at the completion of each day's work on each vehicle operated, except for intermodal equipment tendered by an intermodal equipment provider. The report shall cover at least the following parts and accessories:
'Service brakes including trailer brake connections
'Parking brake
'Steering mechanism
'Lighting devices and reflectors
'Tires
'Horn
'Windshield wipers
'Rear vision mirrors
'Coupling devices
'Wheels and rims

I've never heard that before. You can do your PTI whenever you want once your shift is done. You could be off-duty/sleeper for six hours and do your PTI at 9PM if you want and still be ready to go at 7AM.

You know better than that. You can't break up your rest period.
But yeah, there is no set time. Just as long as you complete the report before beddy time. Whether it's a pretrip or posttrip, an inspection is done prior to driving and satisfies 396.11.
You satisfy what your company wants you to do. Each one has a different way. -
He didn't really break it up in his example, the period 9pm-7am is 10 hrs. Seems kind of weetarded to take an extended break, do the post trip and then do 10 more hrs but whatever floats yer boat, lol!CondoCruiser Thanks this.

Thank you for answering my question. My problem is: I started Tuesday night and did a pre-trip inspection. I drove into Wednesday morning to get to customer. I arrived at customer and made delivery. I drove to the next customer and entered sleeper berth. I did a 10 hr break, got up and made delivery. Went to next customer and drove home on Thursday and then did a post trip inspection. Is this log illegal??? If it is, where?

Pre-trip/post-trip.......daily. Best to log Pre and you can flag post, since you will be "sleeping" in-between, right ? However a lot of companies want 15 minutes shown for pre and post. If you fuel before bed time, log fuel and post at the same time. Sweet dreams...........

Completion of your Post Trip Inspection Report is required at your 1st change of duty status after midnight if your logs run midnight to midnight. After completion of the PTI, a new log page is started to complete your work day. If not done this way your logs will not be current to last change of duty.123456 Thanks this.

The reg says at the "end of each days work." It doesn't say squat about having to do it at a particular time of day or a specific change of duty status. If you're running nights across midnight, there's nothing there that requires you to make that report until you are done for your shift.RickG Thanks this.

Never really understood the concept of a post trip inspection other than to write up of what your going to give the mechanic to fix.
I am not real concerned about inspecting before going to bed. However I will inspect BEFORE hitting the road the next shift.
