I work across the street at Link america in Lakeland. I remember the day the gates were locked down and our drivers were gossiping about the repos. Then the next time I came back it was a ghost town. I remember driving up us98 ans seeing a ton of AAX equipment on someones property.
Crazy how things happen.

stay away, they are ripoff artists extrordinaire, I'm about to post a follow up report on my employment with them. They are liars, cheats, and their equipment is crap.

It's been a while as I worked through some legal issues since my incident with EXP but since I never started a thread directly about them, figure I will recap it here.
They are definitely a shady outfit but I needed work and they were local so I knew I wouldn't be stranded far from home if it hit the fan. Unfortunately my 15 years safe driving caught up to me and while in Dallas a pickup in front of me reacted to traffic in front of him by coming to complete stop. I slammed on the brakes and halted a dozen feet behind him. Meanwhile, in the trailer, I was hauling 'bag in a box' bulk liquid containers that the shipper had loaded with a single pallet in the nose. The forward momentum of 38000 pounds against the single pallet caused it to shatter, the bag to burst like a water balloon, and the rest of the freight shift forward to the bulkhead causing my stopped rig to surge forward, into the back of the stopped pickup. No damage to my tractor, a dented bumper to his truck, no injuries, no ticket, but a big spill of 275 gallons of cooking oil.
After a drawn out week a team was sent to Dallas and one of them drove me and the truck back to Chattanooga. I was fired per the insurance company but I was also not paid, even for work done before the load shift accident. I sued EXP in civil court for wages they refused to pay. After several delays, they counter sued for damages due to " driver negligence". They lost and were ordered to pay me my backpay.
They have not paid me.
The court date was two months ago. I have been working for Ryder Logistics since December and just ran my DAC only to find that EXP has falsely claimed that A) there was an injury in the accident and B) that it was a DOT recordable accident. There was no injury, no disabled vehicle, no citation, and per Dallas PD rules, not even a traffic report. Dallas PD, Texas DOT, and Dallas FD (cleanup) were all on scene and none issued me a citiation.
So I now have to figure out how to get them back to court to pay me what the court ordered and seek compensation for their false report to Hire Right.
ANY O/O considering working for this outfit has now been put on notice that you have been warned. Their equipment (trailers) are not inspected, are not maintained, and their office will not support you in any way. The ops manager, a hag by the name of Ruthi H (wife of Charlie, thier maintenance guy who writes bogus annual inspection reports on the trailers and wont put on good tires telling drivers to "run 'em til they blow') will lie in front of a judge. I got her three times with my evidence countering her false claims. They probably spent $5000 in lawyer fees to avoid paying me $1400 in wages and had ALREADY filed the false employment information with Hire Right.
If I have ever been tempted to be Charlie Bronson and seek revenge against anyone, it is now. They haul for Bowater in Tennessee and backhaul crap from Texas. I can't get a lawyer interested because there's no money in it for a lawyer and I can't pay thousands in legal fees as the state of Tennessee does not allow compensation for legal fees as part of a civil suit claim.
The company is run by the corrupt Limerick family and I have filed complaints with the BBB as well as ripoff reports and can't tell you how ticked off I am that I was in such a money bind that I had to go to work for these crooks.
I could not afford to file a second claim against them and guess I will have to back track and appeal again to some of the lawyers I spoke to about representing me in some sort of libel action. -
I don't know about all of your story, but if you have a judgment against someone you can file a garnishment against their bank accounts, wages, etc., You can also file a lein against their personal or corporate assets. And, Tennessee does allow for the recovery of legal fees if you win a judgment in civil court, provided you use an attorney. Some attorney's will take a case based upon contingency. That means that the lawyer will take the case and if he wins then he gets a percentage of anything that is collected. I don't think that you are telling all of the story. Some of it doesn't make sense.
-
What part doesn't make sense? I worked this through the court system from September through the final hearing in February and not one Chattanooga lawyer was interested in representing me. Each one said I would spend more money on their fees than I would get back in the pay that I was fighting for. Each one told me that court costs are NOT reimbursed in the Hamilton County Civil court general sessions court. The only action I have found is to file an appeal which would then cost 250 MORE dollars out of my pocket. I have asked for help from a local legal aid group but they have also chosen to not represent me in a minor employment case. Instead of accusing me of "not telling the whole story" why don't you ask about what you think I am ommiting? Everything I wrote below I also tesitfied to in court before the judge.
-
I happen to know that you can ask and receive court costs and attorney's fees if you include them in your complaint. That is true in any court in the country. If you win the case then you should be able to collect court costs and attorney's fees. However, you must ask for them when you file suit. If you did not include the costs in your suit then you won't be given them automatically. Did you ask for court costs or attorney fees? You can't get attorney fees without having an attorney. I am not sure why you would need to appeal the case if you won. -
You HAPPEN TO KNOW? LMFAO ! well then maybe you should have been there to question the lawyers I consulted with or the judge who said I was NOT able to collect court costs. You are so uncertain of so many things and use terms such as " should be able " that I am really confused why you are bothering to question me. I wanted to appeal the case so that a judgement in favor (it was split) of the defendant who made a counter claim would have been dismissed giving me the full amount of my backwages. You clearly are unfamiliar with Hamilton County Tennessee and the general sessions civil court. I spent 3 months talking to lawyers and consulting people at the courthouse in how to proceed. Give it a rest.
-
I live in Hamilton county and have used Sessions court. So, I do know something about them. Apparently, there is more than you have posted. If you file suit against an individual or company and don't ask for court costs, then you won't receive them. If you include court costs and attorney's fees as part of the suit, then you will receive them if you win your case. You now said that there was a counter claim against you. The counter claim may be the reason that you were not given court costs, provided you asked for them when you filed your lawsuit. -

Personal life and controversy
On July 20, 2010 Jamal Lewis along with Tennessee hotel owner Brownlee Reagan bought Fort Rapids Indoor Waterpark Resort in east Columbus for $6 million.
In February 2004, it surfaced that Lewis had been involved in talks about a drug deal. Lewis was charged with conspiring to possess with the intent to distribute five kilograms of cocaine and using a cell phone in the commission of the first count.[7] Lewis reached a plea agreement with prosecutors in October 2004 and ultimately, Lewis was sentenced in January 2005 to four months in federal prison.[8] He was released on August 2, 2005.[9]
Lewis currently lives in New Jersey, USA and owns a trucking company. He was present during the Baltimore Ravens Super Bowl XXXV reunion in 2010.
On October 31, 2011, Regions Bank filed suit against Lewis over an unpaid $660,000 loan -
