Greatwide refuses to pay damages when my husband drove for them

    My late husband was an owner-operator for Greatwide. He leased his own truck and ran FedEx routes down south. In Oct 2010, Greatwide asked him to pick up a truck in TN and run a load for them. Greatwide rented the truck from Ryder. During the run, my husband ran off the interstate and died. The autopsy stated he had heart disease and a heart attack killed him. Here are my questions:
    1. If my husband was driving a route for Greatwide and not his own route as an owner/operator, shouldn't he be considered an "employee" at this time?
    2. If DOT physical showed no signs of heart problems prior to him working with Greatwide, could the stress of being a driver eventually cause a heart attack?
    3. Greatwide insists my husband was NOT an employee, but if the rental agreement for the truck he picked up and died in was signed by Greatwide and the truck insurance was also Greatwide, shouldn't Greatwide be responsible for compensating his family under Workman's Comp.

    Lastly, what state is Greatwide located? I am in Louisiana and his death was here too. I would like to speak to an attorney in the state where Greatwide is located.

    Sorry for your loss, but there's something I don't understand. If your late husband owned his own truck, why would Greatwide need to rent a Ryder for him to drive? Why wouldn't he have used his own truck?

    Sorry for your loss.

    The whole thing here can be very confusing, normally an O/O, but driving a rental directly for the company hauling a load. As for his heart disease showing up at a physical, that only involves the Doc listening and probably wouldn't detect something serious, but i'm not a Doc.

    Hi,

    Thank you all for your responses. I am confused to why he had to drive a rented truck from Greatwide too. This is why I think he should've been considered a Greatwide employee during this time.

    Also, my condolences, and I'm no lawyer but you need one.

    IMO the $64 question will be why he was in the rental truck and not his own. IMO the status of that truck / load will cover him.......

    Carriers have loads that are for o/o's and loads for company drivers. The co. driver loads are usually sweeter and kept away from o/o's if possible. It's possible that the truck was rented for a blind shipment too. Only GW knows and I'm betting they wont say.......

    I'm sorry to hear about your husband.

    There are many reasons why he wouldn't have been able to use his own truck. For example, he had a bent tie rod and needed to get it fixed, but the load needed to get there...If he was going to a consignee or a shipper that only allowed trucks into the place that were newer than 10 years old, etc.

    Do you see how there could be a number of reasons?

    It's best to speak with a lawyer if you want to go that route.
