hi, does anyone know if driver file needs to be the same for o/o and company drivers, and do I need to keep a file of a owner operator who only worked for one month?
just starting safety, any help would be appreciated

Yes, I would think you'd need to keep a file regardless. if for no other reason than to be able to answer any verification of employment requests that may come your way months/years from now. They have to be retained for ALL drivers who operate under your authority, but I'm not sure off-hand how many years.

Driver file is the same between both.
You can have a file for ex drivers that you keep for verification purposes. Many companies only keep these for about 3 years. -

There is only one qualification file does not matter the type of driver.
49 CFR Part 379 'Preservation of Records' give alot of good info on all records retention periods.
Part 391, Subpart F - Files and records: 391.51(8) (c) says "qualification files are to be retained for as long as the driver is employed and for three years thereafter."
Even if he worked a week youkeep the file for thre years.
Get the desktop version of the FMCSR, it has all this plus the guideance published by the FMCSA as it applies to each section. Always have a highlighter in hand when you do read it! -
