I know dwi and cdl's don't go together and shouldn't. The question asked is have you ever been arrested for dwi. I can't find anywhere in the CFR 49 that requires an answer to that question. I have been arrested but not convicted and license was not and is not suspended. My driving record shows nothing for last three years. My real question is do these guys do a bonafide criminal background check where they will find an arrest and court date in the future which when i attend charges will be dismissed OR do they just do a state/nationwide driver record in which case the charge or conviction does not show up. In such a case i can answer NO to this question never be found out.

yeah, they pull bonafide background checks. My last company gave me a copy of it and every company I apply to has to offer me a copy of it because I live in Minnesota. State law.
If you are really concerned about it, go to the district court public access and pull your own record. You will see what they see. It's nothing special really and no one is snoping someplace they don't already have access to.
Click on "Case Search" on the right side of the screen and fill out the form for the area you live in.

Waitaminnit..... is this "arrest" while you were holding a CDL???? If so, that's a whole different kettle of fish.

A carriers application has a section asking about tickets, accidents, and convictions. A pending court case might not show up but would later on after the case is heard.
Carriers run a DMV check each year. A driver must disclose any accidents or convictions to his/her employer prior to this yearly search.
ANY falsification of an application can result in immediate termination for falsification of app even years after the fact. -

I take no conviction to mean it never happened. Anybody can be arrested and charged. Yeah, most people arrested ARE guilty, but with our system, we can defend ourselves and be found innocent, right ? Look at O.J./Robert Blake.

So I was driving my personal car and was stopped at a sobriety check point lost my license immediately for one year. I have hired an attorney with hope of dismissal. There is no hope to find any job at this point let alone a truck driving job. Be aware!!!

The only solution is to avoid alcohol unless you have a DD to tag along.
My good friend was at a bar and she got loaded. She had drove there and knew it was wrong to leave in her car. So she called a cab.
Well guess what. It was HOT as hell outside, so she hopped into her car and fired it up (A/C) to cool down.
Cop pulls into the parking lot and she got questioned and tested.
Blew a .11 (OUCH!).
Sadly, even having the keys in the ignition is a bad idea.
She tried to fight it - lost. But they gave her an occupational license
to get to/from work..with strict rules.

Applying for any job is not working - everyone checks for DWI - cannot even get a job as a landscaper - warning do not even think about it even when you are out on a date on a weekend night!

My working life is over at this point - 57 years old and now no jobs available.
