Extension of time period for comments on SMS

Oh I would say no one is gonna get an audit over a light, and that is the maximum net result of any points. Now if a company a light out every time they recieve an inspection I for one would want them looked into. Consistent infractions indicate lax behavior and habits.

You are correct I have no problem with a record of a drivers or carriers failures being recorded in a data base to highlight them for safety audits. No problem with that whatsoever.

I fail to see how keeping track of someones record could possibly be unconstitutional. I am sure you like others have a myriad of theories like due process, the fourth and fifth amendments and the like. None of those apply because this is not a criminal or prosecution.There is no Judge or Jury because of that very simple fact. The net result of any SMS results for a carrier as far as the government is concerned is an audit.

Now the point of the thread is the FMCSA is asking the public what if any changes they would see made, and or general comments on the changes coming to the SMS methodology, like more than one person's contention warnings should not count as equal to a citation. If you feel that way post your thoughts on the matter. I would suggest making clear concise points pertaining to your belief inspections with only non-cited infractions(warnings or fix it tickets) should not be used, or at least weighted as less than a cited infraction.

Meaningless tirades about the state of the industry, your understanding of the USC, or equally pointless comments will most likely be disregarded.

 

I am confused by you people. How is posting a link to effect change in a program you people have issues with, and offering advice on submitting comments derogatory?

I find most people very odd and unwilling to think I will admit, but my advice was solid despite that fact. Submit comments or don't, most would rather have some boogey man to complain about than work towards addressing problems they see I guess.
