    Sorry i didn't read all of the posts. Did you have an attorney read the contract first? If you are in the trucking business you need a full time retained lawyer. Most will get about $500 to be retained, they will charge about $150 to $200 per hour to deal with contracts, and pay disputes.
    It sounds like a lot of money but imagine how you would have been treated by Prime management when you pick the contract up from the DM's desk and say "i'll just have my lawyer look this over and get right back with you"... Shake his hand and walk out the door. Suddenly you're not just another dumb truck driver to them.
    If the lawyer says its a bad deal (and he probably would have) then you walk away. If the lawyer says its a good deal, then you go back and sign it knowing that if they don't live up to their end, they know your lawyer will be calling.

    I should have had an attorney read it over that would have been the sensible thing to do. There are three items that they breached the contract on 1. They promised to provide a serviceable unit. 2. They guaranteed a minimum of $1.02 a mile and there is no language authorizing them to keep anything I made over that. The deal was 72% of the line haul with a minimum of 1.02 .3. Was that they would replace the 4 drive tires that would not pass DOT with new tires at their expense prior to my signing the lease. They replaced the tires and billed me the second week. You are right an attorney involved representing my interest from the start would have produced a totally different out come. Another lesson learned.

    I hope you land on your feet. There are lots of good companies out there and with your experience Im sure they would love to have you. Time to get on with life- your family will appreciate it

    Admirable but that's not what he's saying......and I have basically the same questions: With 19 years experience and in this economy what exactly were you thinking?

    My point: I have solid experience, some of it tanker team and I'm not sure that a team could run this truck / deal. I mean $1.02 capped and $1100 week fixed costs before fuel ? I'm sure it's possible in a perfect world and I see the Prime guys humping glass into the port but those are short hauls. And you signed up for a single operation?

    Even if you made the deal work and kept Prime pushed back, there wouldn't be much to send mama and you would kill yourself trying. What would be the point? You would be against the wall every mile and forget a breakdown, the note would eat you alive. One of the mega's ( Celedon? ) has a note per mile deal....you don't roll, you don't owe. That might be do-able depending on some things.

    Before you close this chapter, make lemon aide from lemons........ document everything, it's tax deductible. You shouldn't owe any taxes for a year or two unless you fall into big money somewhere.

    LOL.

    I love that question you asked him. Did he ask what difference it made if he had 10K? It would probably be a real eye opener if you told him that it would all be yours in a few months if he leased a truck from you (even IF he didnt have any mechanical issues).

    Fact of the matter is, there's a TON of info about the Prime lease on the net. Some good. Some evil. Anyone going into a business situation should do a considerable amount of due dilligence. Just my 2cents.

    I think that the reason you're getting all this backlash is because you're not the first person to come to this forum and blame the Prime lease for your ills. Those who came before you paved the way. :)

    You were a driver with 19 years experience and you went with Prime? And did a lease???? Why don't you tell the rest of the story.
