Hi everyone,
I need some advice: We hauled a load of produce, tomatoes, from Ca to NY. After 45 days of receiving the original POD, the broker is not paying us. He owes us $7500. I call him and he says he doesn't have the funds. I call the shipper and he says there is nothing he can do since he already paid the broker.He also told me that he paid the broker less that what he owes us???? I called his fund, but apparently you can't file a claim on agricultural products.
It was my mistake to not check that broker credit score.
I don't know what to do now.
Please advise ASAP!

Especially is the broker was scamming how much they were paying you compared to what the shipper was paying him. That just reeks of fraud.

That's why perishables ship COD>
After all of this the only recourse you may have is collecting from the shipper. -
i have no experience in this but could you use a non recourse factor

After a few issues you develop a sense about who you can extend credit to and who is COD. I would consult a lawyer ASAP.
