I got an overweight ticket. I know with a lot of tickets it is best to fight them. I was given a choice of taking a log book ticket (was put out of service) or a overweight ticket. I opted for the overweight ticket even though it cost more. I would rather have to list an overweight ticket than a log book violation. I figure there is no way to beat this and could take a chance on the cop not showing up in court, but figure I would be better off to just pay the fine as it hard to beat. Any input? Thanks.

Just when you least expect it, the COP shows up!
I had one incident where the COP did not show up but that's just because he told me if I wanted to fight what I got, he would not stand in my way and would let it be dropped. Must have been that pretty smile I gave him that day, lol

You could always take that chance of them not showing up? He might not for just an overweight. It never hurts to try! How much is the ticket (if you can reveal that is)

One thing I learned in my 4 wheeler experience is ALWAYS show up for a ticket. You will always have a chance of him not showing up and getting it dropped OR a nice DA that will lower it to something less painful. Don't know if this is the same for big trucks too.

How much were you overweight? Gross or axle? What state? Port?
How bad was your log book violation? Just out of hours?
This seems like on odd choice; logbook or overweight ticket.
Was it a DOT cop, a regular bear, or just some local yokel?
Lastly, what list are you listing this on? I don't think either of these are moving violations.
I can't really offer much input other than to suggest you pay more attention to where the coops are located and make sure that your log makes sense. If for some reason it doesn't, by all means stop ahead of time and correct any "mistakes" you may have made regarding time, distance, location, etc.

In the State of California, the log book violation WILL show as "points" against your record. The overweight ticket will NOT. This is one thing I know from years of hassling with all this BS my hubby does!
Your best off, I think, to take the overweight and be done with it. But I don't know how this stuff shows in other states... -
Well over weight is better then having a log violation , Well it depends on the state but anyway made a smart choice if it was me i wouldnt have time to go to court

#### NoTarps, I feel for ya bro! I recently got a logbook ticket in PA (logbook not current to last change of duty status, DUH! Esp since I loose leaf), and got lucky- it doesn't show on my MVR and thankfully, it doesn't show up as a misdemeanor (in some states it does). Good luck fighting it, I had no luck, but the fine was the hardest sting of the whole thing ($140).

Remember the first thing DOT/cop is going to ask for is Drivers licences & log book. When looking at the log book the first thing they look for is to see if it's current. If it's current they may stop right there, if it's not current trust me they will find everything else wrong with it possible.
