Question about a 42,600lb RV wrapped with a commercial advert

    Diesel motor homes with air brakes, require a cdl when being moved by a driver, but not for a private user. The GVWR of the vehicle is the key.

    Weather a CDL is needed or not, if you get "PAID to DRIVE a CMV " you have to have a DOT medical card no matter how big or small the CMV is. Also must have a DOT # on it /not for hire, or the name of the company.

    I was "hauling" my own PERSONAL PROTERTY (race car) Doesn't matter IF he is hauling anything or not, he IS getting PAID to drive, HENCE COMMERCIAL.

    Being paid to drive it has nothing to do with it. A rich MFer could hire you to drive him and his wife in their privately owned motorhome while he sees the country on vacation....and while you are a hired driver, you are NOT driving a commercial motor vehicle because the vehicle is not being used in commerce. Wrap an advertisement around that SAME motorhome, and now it is a rolling billboard. The product or service being advertised is paying money to have that wrap on that vehicle, and for that vehicle to be on the road...and so it becomes a commercial vehicle.

    Same with a farm truck...you can be paid by a farmer to drive his truck hauling his grain from the field to the elevator, and it is still just a farm truck...not a commercial motor vehicle. If the farmer sends you to somebody else's field to haul their grain to the elevator, and if the farmer is paid for that haul, you are a commercial motor vehicle and subject to all of the

    The vehicles size and use are what determines whether or not it is a commercial motor vehicle subject to the regulations....NOT whether or not the driver is paid.

    If I remember right I posted CMV to that post about being paid.It has nothing to do with the rich MFer..
    For once SIZE has nothing to do with it. If a Vehicle is Registered as a Commercial Vehicle and YOU are paid to Drive It, you MUST have a DOT MEDICAL CARD. It's a FEDERAL LAW

    Federal Motor Carrier Reg #391.45
    Any driver authorized to operate a commercial motor vehicle

    Here, I'll quote you again...try to read it this time:

    Look up the definition of what a CMV is.

    §382.107
    §383.5
    §390.5
    Size and use of the vehicle have EVERYTHING to do with whether it is a CMV or not (per the definition of a CMV). There is ZERO mention of whether or not a person behind the wheel is being paid to drive it.

    If the vehicle meets the definition of a CMV, then the driver must follow all of the regulations in the little green book pertaining to the type of CMV he's operating. If the vehicle does NOT meet the definition of a CMV, then you don't have to worry about the regs.
