    Hi there,

My husband just started with trainor and he is just not happy. He goes out for 2-3 weeks at a time and he takes maybe 2 showers. Is that normal? MY husband drives his 10 hours and then it's this guy turn and he will drive for maybe 3 hours and tell my husband he needs to drive again. And to mention my husband has had no sleep. This guy wants the truck running constantly but isn't this illegal? My husband is very stressed out and just wanting to quit. This is a new career for him and we have babies so we are in need of this salary. Any advice?

How long is he supposed to be with this jerk? Can he hack it until that part is over? No, it's not right but it's hard to complain and not get in trouble. If he can just get through this part and survive it, it WILL get better.

And, no, what this trainer is doing is NOT legal. The truck CAN move all the time but that's team driving. Technically, at least in Canada, a trainer is supposed to be in the passenger seat when your hubby is driving. He is NOT ALLOWED to be asleep in the bunk when he is training but, obviously, not everyone plays by the rules.

How old is your hubby? How much experience does he have? Is he fresh out of school?

It's always a tough issue when you have been stuck with a bad trainer. You have the problem of being the new and low person on the totem pole, and never know how your complaints are going to be taken up above if you make them. So it's always a crapshoot to go to the company and complain about your trainer, because the company could care less as long as the miles get recorded. They also may handle the problem properly, but you never know which side of the coin will end up on top. It's a risk, and I have never developed a really good set of advice for this situation, because of it.

In this case, the lack of personal hygiene, sad to say, is not unheard of, and there really is no way to enforce that. a complaint can be made, but it's an almost impossible to prove thing, so it won't get much attention. Hopefully, the problem can be lived with long enough to get out of this clown's truck and get your hubby out on his own.

As for the driving and rest hours, there is a full valid legal remedy to that, and it's in how your husband logs things. As long as he logs strictly by the book, there is no way that he can be forced to get up after a 3 hour break and get back behind the wheel. The only way this can be going on now is through some sort of logbook falsification, so tell him to stop that and comply with the regulations. The rules in this case will be his shield and will protect him from being abused this way by his trainer. His trainer may not be happy with that, primarily because right now he is accepting more miles to the ruck than a solo driver can possibly run, and is using your hubby to make that happen, and logging legally will bring that mileage number down to sosmething more realistic.

As for the requirement that the trainer be in the passenger seat, that is the correct way for it to be done, and what should occur by the book. and as a result, a truck in a training situation should never acheive more miles than one running with a solo driver. But, unfortunately, that's more in the realm of fantasy than it is in the real world. As a driver progresses further in his training, I see no problems running more in a team style, but it's an issue in the very beginning of the training period.

Bottom line here, tell hubby to log strictly legal and by the book, and hope that he can get away from this numbskull in as short of a time as possible. Then, remember it, and if the guy is training someone else later on and they appear to be having problems, back up their story and get the management involved after you are no longer a trainee.

it's not a great solution, but it's the best I can come up with here.

Not only is what this trainer doing illegal. It's typical of trainers who do it for the money.

Your husband should drive NO MORE than 13.5 hours in a 24 hour period. Provided he has the needed breaks, and time.

If the trainer does not want to drive a FULL 10, then the truck should be parked....period, to allow your husband a full 10 hour break.

My advise, have your husband call the company and request another trainer.

If your husband has an accident, it will be on his shoulders. He is responcible for complying with ALL rules and regs. Forcing a trainee to operate a commercial vehicle illegally, is also illegal.

If all else fails, tell your husband to pull in at the nearest scale, and have a long talk with the DOT officer inside. There are whistle blower laws in place to protect your husband.
