There doesn't have to be solid proof in a civil suit . If an attorney's discovery shows the carrier had multiple violations on record or proof other drivers pulled overweight loads how do you think a judge or jury will decide a verdict ?
Western Express might even agree to a reasonable settlement to keep evidence from being recorded public documents .
On the other hand , from what I've been hearing Western Express may go broke before the case ever gets to court . -
As long as the contract both parties sign does not involve breaking the law then it is valid. Example: You can not enter a contract for slavery even if both parties agree to it. You can argue that you were deranged or drunk so not responsible or, as in the case of the recent mortgage crisis just too stupid to know what you were doing, but I think generally speaking contract law is pretty settled. Enter a private contract and live up to it or be forced to do so at the price of penalty.

Except for the part where there is probably more to this story. I would assume, and I probably shouldn't, that Western Express is smart enough to document, document, document. If they were they can show that he was termed for reason X, Western provided ample opportunity for the driver to improve, he failed to meet the requirements of the improvement process. That's where I defend myself, or I would if I had a company and you know employees and such.

This is a true statement. My truck weighs 32280 mt, and I get overweight loads all of the time. you just have to not fuel up before you go and get fuel as needed as you go because they fully expect you to take it. And it IS forced dispatch, no matter what they say.

I can't prove it, I drive flatbed, but other box drivers that go to that particular shipper tell me that they won't take any off.

If I'm off base here I apologize as I haven't read the whole thread.(last 3-4 pages) but I use a 2012 Peterbilt with DEF tank and usually pull a flat. When in the NW I get a load of lumber 99% of the time and I scale right around 32,000 empty with half fuel tanks..
I usually bring the load of lumber back to MN...On....yes...half tanks of fuel. What's the Big Deal.? I have been doing this for years..roadwarriorflatbeder Thanks this. -
I never fill up on fuel or DEF before pickup. It's basically surrendering a load. If you can't scale it, you lose money by not running. As company drivers, if it's legal, run it. If its 79,980, run it. Your legal, it's not your truck, it's not your fuel to worry about weight so shut the door and go.... Just my rant to a poster complaining about gross being high
