I have an upcoming trial for driving a commercial motor vehicle with defect (push rod stroke exceeds prescribed limit). Actually it was my previous trucking company who requested for the trial to challenge the evidence. I don't know what to do. I am not connected with that trucking company anymore. Any advice please.

The company is challenging the charges to protect their National Safety Code profile, I doubt you will have to be involved. Is this the result of an accident ?

Someone did not do their brake check. Yup in Canada where they have 8 and 10% grades they are kinda anal when it comes to the brakes on commercial vehicles. I guess it depends on if you left on good terms or bad. You could say you did all your checks ect and everything seems to be within limits based upon your limited diagnostic equipment. Or you can screw them over greatly by telling the court that the company would not supply you with the proper information on what was required that you had requested.

Get a lawyer, only advice, find one that specializes in defending truckers and transports.
