Accident Witness :IMPORTANT

    Hi everyone...let me do some clarifying on this post as my husband wrote it for me the first time it was posted.......Some very important information was left out...Hey drivers, i was involved in an accident i-80 westbound Davenport,Iowa mm 289 with another truck around 8 am last wednesday October 3rd . After merging from the 280 on to 80....which merges into the fast lane.It was quite congested ..time between 7-8 am traffic....Cars were not allowing me to merge to my right lane....now remember there are only two lanes.I saw my opportunity to get to my right let two cars go ahead ,blinker on got ouver.I saw a semi pulled off to the shoulder no flashers or emergency triangles from my position....remember this is happening in seconds.I noticed the semi was aweful close to driving lane . First car of the two ahead of me slightly swerved around...the one directly in front of me same thing .By then I could see what was happening but there were cars bumper to bumper on my left. NO place for me to go as I was pulling two trailers.The semis left rear end was about 1-2 feet out in the lane of traffic.My right mirror hit his left end.By then cars around noticed what was happening and trying to get over to the left as soon and as far as possible. I was able to get enough space to get my first trailer around but my second trailer couldnt get around him and then all hell broke loose. tore my rear trailer open and his also.I immediately pulled to the shoulder ahead of him.Now I have witnesses after but no one stoped before the accident...leaving no evidence for me to say his end was out and no hazzards on.If there is anyone to witness the before PLEASE contact me. When police asked him what he was doing hes admittedly said he was trying to merge into traffic.Officer said from a complete stop?!!!! I have been placed on suspention until this is resolved .I got a GD ticket for "Failure to comply with safety reg rules"....what the hell!!! I could possibly lose my job because the insurance cost came to23,000. 00 all together .I f there had been a way out or if he had had his hazards on I would have possibly been in a different position.....I love my job and dont want to lose it. I ALWAYS move to next lane for safety when I see a problem ahead....I just didnt have the time or space .I also was not driving fast...and there was just no last second moving area.     That sounds better than the first post. Sorry it happened. The odds of finding a witness on here is less than 1%.

    Your best bet is to advertise locally because at rush hour most likely there was a local driver that seen the whole thing. Maybe try city-data forums, spam craigslist :) or even the local newspaper or their website.

    You can see from the wet stain on the pavement, those trucks have been moved. Those pictures tell you nothing but the extent of the damage to one trailer. Nothing about placement.

    Get the police reports.

    And get a lawyer. And get your comments OFF this forum. It's all discoverable testimony and you got a hard fight against you.

    Kim at minimum it's not the end of the world. Many companies allow two-three accidents. If not with this company there are other good driving jobs out there. Your career isn't over.

    Be thankful that you and nobody else was injured is the main thing.

    Seeing the left side of your trailer damaged must mean the guy was sitting on the left shoulder at a major merge thinking of bullying his way back out. Not very smart at all when you decide to check something. There was many safe places to stop right down the interstate. If I was a safety guy I would of been all over that other driver. Good luck finding a witness but don't beat yourself to death over this.

    Well said MN...... That's a whole new chapter in law 101. Searching social media....... can be used in court and a staple of civil training as well as criminal.
