At this point its water under the bridge, however there may still be a chance for you but its not going to be easy. First and foremost be honest with any perspective employer and realize you probably are going to have to go with an O/O or some kind of building materials delivery (lumber or dump truck) to start with and its not going to be a great employer. It may also benefit you to offer your employer weekly drug tests on your dime for the first 3 months or so (this will be expensive). The problem is you've demonstrated poor judgment and now its going to be a fight to prove you've learned your lesson. I'd say the biggest way you can do this is be honest and keep trying.
If you ever get pulled over and this shows up on the officers computer screen you can expect to be searched, or at least thoroughly looked over. The only other thing I can think of as constructive that may help is to go through drug rehab. This would suck and would be expensive but at least rehab would show you acknowledge the problem and sought professional help.

I honestly am not just looking for posts that I feel are "kind" and "gentle", I am looking for some "staight" answers, which I have not gotten so far, that is PERTAINING to my QUESTIONS. Mostly peopple are just posting their COMMENTS regarding my illegal drug use, which, AGAIN, yes I totally am admintting FAULT, but I am ASKING if anybody would know of getting an EMPLOYMENT record off of the DAC, so I could avoid the delay in my truck driving opportunities. I am NOT avoiding my troubles or consequences by just lying that I have not had a positive drug test, AS PREYIOUSLY stated: I completed the DOT's mandated "Return-to-Duty Process" per FMCSR part O sect. 40.281. Now I am merely tyring everything, LEGALLY possible such as challenging the "employment record" that the company, where I tested positive on a "PRE-EMPLOYMENT" drug test at, put on the DAC that I was EMPLOYED. Because of NOT BEING AN EMPLOYEE the company CANNOT an DID NOT, repeat....DID NOT put on my DAC of a failed drug test. Sorry if I might seem a little irratated in some of the "typical" responses; i.e......."crack-head on the highway" or "try flipping burgers at McDonalds".....I DO feel are "uneducated" and not PERTAINING to my QUESTIONS, but rather spewing anti-drug rhetoric. Again,.. you are only commenting on your conclusions of your PERSONAL feelings and NOT having an ANSWER to my QUESTIONS. I could careless if you feel "mistakes" are only that, and you see there is no way to approach it in a positive manner and try to make the "mistake" a way that might challenge ones will, enhancing their fight, and in turn making one stronger as that "mistake" redirects one into a greater being.... Makes absolutley no matter to me, I am looking for ANSWERS not comments.

Again....I totally UNDERSTAND in how ALL of the trucking community does NOT want a "druggie" driving a vehicle with a great deal of destructive powers; i.e....killing or maming a lot of innocent people. I cannot get to personaly meet each and every person, and face-to-face, have a chance to let for YOURSELVES deciede whether or not I am ready to ACTUALLY drive a rig, just as anybody. However, I myself, and professionals [SAP] have DETERMINED that I am ready to resume my attempt at becoming a truck driver. I DO want this dream to become a reality and there is nobody to fault but MYSELF that I MIGHT have to delay it for a year or two, which would be bad to my situation. BELIVE ME when I say this.....I DO realize the ZERO tolerance and agree with the industries following the policy, which is there to protect the millions of $'s that the co.s have invested, of "reckless" and "unworthy" drivers that would be a liability in their company. I, by my own doings, have shown to my first company that I went to an orientation with, that I AM a risk, that they do NOT want take, with my failing the drug test. I do not fault this procedure, I am merely trying to find a "technicality" in which I will not have to wait a yr. or longer to give myself the second chance at proving to be worthy of being in this industry, as I DO feel that I am not a person who has a problem with drugs and has TOTALLY learned the "lesson" of ZERO tolerence first hand and I feel that this happened to me for a reason now, and not down the road when this lapse in judgement COULD HAVE impacted innocent people and would not have a chance for redemption, as I have now. WHY do I deserve a "second chance?"......Beacuse I feel as if mistakes are a big part of what makes "us" human, and not a machine, which is capable of not making a mistake or any other of the qualities, such as FEELINGS, that make us UNIQUE. Good qualities to have.
CyberGal... with your clout or knowledge do you know, if my question that pertains to my "employment-history" can be challenged, which is THE reason behind my posting all of this information..and not how "Well-WORDED" of the responses,....though,...Thanks for your response.

Thanks for the advice BrickMan, also do you know if any local dumpers would hire a "newbie" in my situation, or someway to make the hiring process a little smother:i.e.....offer to train for a week free or something in that manner?

Jeff,.....I do NOT feel as if I am "trying to get around the consequences"..I feel as if I am MERELY trying to find a legal way in the system so that I CAN get into this career without having to wait 1 or 2 years. My consequences were that I had to go see a SAP provider and complete ALL "Return-to-Duty Process" per FMSCR regs, which I DID. Like I said before; my dispute is whether or not I was an EMPLOYEE at the company, I belive I was NOT, therefore I AM trying to "get around" this aspect of it ONLY. I definitely am living with my consequences; just because I might have found a LEGAL way "around" PART of my troubles does not make me any less responsible, just maybe, a little more
AWARE of my legallity in this matter for which I am in. Right.....?

My past is definitely "water under the bridge" I am trying like hell to move forward without knocking my head into a wall over the ABSOLUTE lack of judgement I HAD. Now I am seeking a way to get the DAC cleared by fighting the "employment history" that was put onto it [DAC] by the company that I had a + drug test with. If this cannot be, I will likely get a job with a local company with, like you are suggesting. YES,...it is going to be a FIGHT and prove that I am "clean" and be "a worthy risk", one that I am ready to do battle with, and confident with my abilities....About the statement in which you commented; "getting pulled over and getting searched, etc....." .....there is no record of my "failed, 'PRE-EMPLOYMENT' drug test" except for the laboratory, Dr., company at which the test was for, and me, NO one else is BY LAW to recieve this information. Although, when you apply at a company and sign your permission to have your "employment-history" checked out, the company CAN then LEGALLY recieve the information regarding the positive drug test. I have COMPLETED counseling which was lenghty and EXPENSIVE, but actually, quite informative. I thank you for the OPEN minded reply.

I just found out that a test i took 8/1/07 tested positive for mary jane. ok guys i know what your going to say why did it take 4 months till you were notified well Il tell you i left abruptly after finding out my father was loosing his leg from dieabities,so i moved and had them send my last check to my parents house. after taking care of my father i applied to a local trucking company and was told i failed a test in August. so i need to find one and was wondering how to do so

You are responsible for your actions, deal with them.
No one made you post your story on this forum, Deal with the responses you are getting, instead of engaging every one that responds to your situation and supporting every positive post in your favor.
Regarding your actions:
Im pretty sure the murderers, Drugies, Thieves, psychopaths, pedophiles, would say the same thing, they are sincerely sorry for their actions and would do anything possible to get their life back --- Anything. They just aren't posting on these forums.
A technicality? I agree it sounds like you have one in this case, Regardless might not hold up because of your actions. No one wants to put Druggie and Truck driver in the same sentence. Anyone that hears these 2 words will run. Also has to deal with the environment around you by you have to be surrounded by certain people to be able to get these drugs - No one wants to be affiliated with that especially a trucking company.
Your situation: (This is my opinion)
Similar to planning to hire a hit man to murder someone you know even it it never goes through and saying you are not guilty because it technically never happened. The act of even attempting (Doing drugs) being convicted (Drug test) and the murder not happening (You not being hired) will get you in lots of trouble.
What if the drug wasn't detected in the tests, you wouldn't be here posting and even thinking twice of your actions. Chances are greater that you would do the drug between driving because there were no consequences to you at all. It might even reinforce you because it did not show up on test as you expected it to.
P.S:
Reading some of your posts i wonder if your still on Cocaine?
