I recently left a company (not sure if I was terminated but I didn't quit). After recovering a truck for them, I was sent to a terminal to have repairs done to the truck. Since I couldn't sleep in the truck, they approved for me to stay in a hotel and paid for my meals. I just went on their website to see what my final paycheck is going to be and I'm not happy!!! Not only did they charge me for the hotel/meals, but they also charged back the orientation pay and drug test!!!!!! I need advice to find out if this is legal for them to do. If it isn't, how do I go about collecting the rest of the money that is due back to me? Thank you for any advice!!!!![]()

Okay, but what is legal? I'll have to look in my paperwork that I signed. But how can they make me pay for hotel/meals when it was approved by them and they said they would pay for them?

I don't think that they can make you pay back anything. They can withhold pay for orientation etc. for as long as they want, but once they pay you they can't get it back. As for they motel and food costs you would have to prove that you have either a verbal or written agreement that states which party is responsible for those expenses.

I was paid orientation back in July when I started with the company and was employed with them for 99 days. As far as the hotel/meals, it was verbally approved by the manager. So I don't understand how they can charge me for either of these.

"verbally approved by the manager"... Well, there's your problem right there...... You had / have only that person to go after for the meals and or Hotels. If he (or she) now approves of those, youd could get reimbursed. Now that you are no longer an emloyee.. best that you just give that up unless you really want to beat your head on a rock.

Well, as a company driver, you would expect that someone will stand by their word!!! The truck I recovered was trashed and the single mattress in there couldn't even be used. They approved the hotel stay after examining the condition of the truck. I'm not going to beat my head on a rock over it. I've just never heard of a company taking back your orientation pay or having to get something in writing that was approved. Being adults in the working world, the trust/respect factor should be present.

I'd start reading my offer letter and anything I signed (assuming you have copies). If there isn't a clause that states you must work ex number of days for your orientation to be free I'd press the issue. If there is, just walk away and post about them in the bad company forum, but if you do please provide details so others know that they actually suck.
