Need answer regarding what an employer can/can't deduct out of final paycheck

    Way ahead of you on posting them as a bad trucking company. There's one person employed by Link that can be trusted and they're looking into why the money was taken away from my pay.

    It just floors me that these companies want you to be professional but they can't even uphold their professionalism!!!! (and most of them are "supposed" to be college graduates)

    For these people to be in the top positions that they hold, they fully understand and practice the statement "All is fair in love, war and business" to the point of breaking law although often exceeding and challenging the limits of law. And they themselves receive direct orders to do so.

    If you're not even sure whether you were terminated or quit, how do expect to understand your "rights" and what's "legal"? There is a HUGE legal distinction between being fired and quitting. That question needs to be answered.

    I'm thinking he just stopped going to work. It's pure speculations based off of nothing at all. If so I'd say you quit.

    After reading your paper work and finding out whether or not the company legally can take back the orientation pay they already gave you or not. I would let them know you are calling the better business bureau along with the department of labor and letting them know that the company illegally took your orientation pay out of your last check. Odds are once they know you are not playing around they will give you your money back since just paying you would be less than the fines from the labor department. Good luck.

    This is way worse than just the use you up companies like Swift and all the others. This is total BS, and hope you press the issue and get your money back.
    Call and talk to the boss there first, and usually if you're cool and calm, and they know you aren't lieing, then you'll get paid back. If you call cussing, chances are you'll have to fight harder to prove you're not lieing.

    Well, if you don"t have the reciept, and they won't give it to you, then likely they intend to deduct it on their taxes. If they charged you for the room and stuff, then deduct it themselves....sounds like income tax fraud. Probably wouldn't go anywhere if you reported it to the IRS. They likely have bigger fish to fry. But bringing it up may either get you your money back, or get you a copy of the receipts so you can at least take your legal deductions.

    Most companies show the details of your pay and costs for each load (ie. truck repairs, hotels, and what nots) itemized on your settlement sheet. So the way it would look on there is has if you paid for all cost involved for that load out of that loads payment. And of course each day listed shows each load done and cost. They do this to keep track of when and why what cost were involved per load to assigned truck and trailer at the time load. (better record keeping for them) Now at the bottom of the settlement sheet it will show them adding the cost out of pocket to you back into your totals but in the non tax rembursement section. They probably did this that way for you. Then after taxes and what not on the last line they took back the orentation money. And for some reason you no longer work there. So in turn they most likely paid you for all services, (ie. hotel, food and what not) then took a recovery fee for you not lasting the terms. depending on what you made, it may have been enough to cover cost or may not have been. Considering I don't know what the companies policy even was, you aren't to fourth coming on all the info involved. So were you fired or did you do something to make them think you quit? I sure they gave you a handbook of some sort. But I would think before I didn't know what happened to my job someone whould have to answer me on why, unless I already knew! File unemployment against them if you can for reduction in hours without notice. Most likely they will pay it. Hope this helps.

    No, didn't just stop going to work. I was at the terminal and a little pompous jerk came out and started giving me crap. This all resulted after being in an accident the week before, which wasn't my fault. They sent me to recover a POS truck the following week and, because the truck was in such bad shape, agreed to put me up in a hotel. The week after, the TM came to me and gave me an attitude again. Then kept saying over and over "then you resign". I kept telling him I wasn't resigning. Turned around to find a cab waiting for me. Found out this happens all too many times with this company. They owe me 2 paychecks. I've heard "the checks in the mail for almost a week now"!!!

    You make a determination!!!! I'm not a slacker but I'm also not going to get walked on!!!!
