I would get it towed to a safe haven until you make arrangements to pick it up. You said it's a new truck and the driver may still be using it, or someone will notice it sitting there and start picking it apart. Lawsuits will cost you $$$$ and this guys a flake, flakes don't have $$$. Withold any money owed to him and do not give him a good reference if anyone calls. You need to be a member of DAC to post anything bad or good about any employee. Sounds like you need to pick better employees.

Police won't take it as stolen, because you authorized him to drive it, to begin with. A friend found this out and he was a former cop.

This driver sounds like his kneecaps need to visit the business end of a baseball bat -
ist recover your truck, put a report on dac on him for abandon your truck and i would sue for dammages and all loss income do to the time he kept your truck parked or did what ever with it while he would not comunicate with you. what ever the judge puts on as settlement will always be on his head and against him also it only cost small claims court filling fees and to hire a private I to serve him. you can garnish his wages thru his social security number thru the court. it will catch up sooner or later
