Can my company do that?

    Engine had 900k miles on it. It was a 2000 Volvo with an N-14 and super 10. They knew the engine was having problems prior to this even happening.

    I paid for the plane ticket out of my own pocket including the $60 cab ride to Spokane from Hayden, ID

    Well the mechanic said that the piston came apart and went thru the turbo.

    I don't believe you can be classified as an employee and be paid as a 1099 independent contractor...I would contact the IRS on this issue especially if you have documents showing you're a company driver but not being paid as one.

    Let the boss man know you will be filing a small claims case against him and his company for your wages and now so much per day that you haven't been paid the check he is holding. Either he understands you mean business or he will soon find out. If you are driving his truck and he is picking the loads for you then you are an employee and should be paid as one. No 1099 as that is illegal. Get the IRS involved and the labor board and I bet he changes his attitude.

    In almost all cases, withholding earned monies for any reason is illegal. If they determine you are at fault for the failed engine, they must take you to court and prove it to get you to pay for the damaged eqpt. I would call an attorney and let him communicate with them from here on out.

    Sorry I missed this. The mileage more than explains it. Tell him to plastigauge the remaining rod bearings and I guarantee you they are more than out of tolerance. In other words it was in need of a rebuild.

    The life of an engine all depends on it's maintenance and how previous drivers took care of it. 900,000 is good mileage for one that has had a rough life. They don't last forever.

    The guy probably had this planned out to push blame on someone else for his own neglect. Sheister! :)
