Blackballed by company unsatisfactory safety record

    Lets see. As I see it first you got a speeding ticket for 11 over, one month or so after starting with this company. They were nice enough to keep you on, as they could have terminated you then. Then you signed a paper stating that one more infraction and you could be gone. You violated the HOS by not waiting just one minute more before starting driving. Sounds to me that that was the other infraction you signed the paper about. Both your fault. They are the bad company because they terminated you for that additional infraction, which you signed a paper saying that you would not commit. Sure sounds to me that its all their fault and you are completely guilt free. Maybe they need to be closed down since they treated you like anyone else they warned once, especially since you are special.

    As for the money they supposedly owe you. There are other avenues you can take to get these. Small claims court tends to come to mind.

    Like some of the others have said. Its your fault, and you need to own up to it and move on.

    396.13 Driver inspection.
    Before driving a motor vehicle, the driver shall:
    (a) Be satisfied that the motor vehi- cle is in safe operating condition;
    (b) Review the last driver vehicle in- spection report; and
    (c) Sign the report, only if defects or deficiencies were noted by the driver who prepared the report, to acknowl- edge that the driver has reviewed it and that there is a certification that the required repairs have been per- formed. The signature requirement does not apply to listed defects on a towed unit which is no longer part of the vehicle combination.

    I already covered this, and I see nothing in what you posted that says I have to do a pre-trip
    inspection, much less log it as such.

    Personally, I dont know why I care about the slash I got on my dac. I'd rather sit home. Ive got offers and denied some. It's no secret that the miles are worst than ever, elogs, office morons who take advantage of your driving record? Who needs it...not me. Better off with another career move. Im not looking forward to even going back out on the road. Im pretty tired of running illegal just to make a paycheck past 800.00. The whole 9 yards. Is it really worth it? My time is too valuable to piss away. Once you think of a new career move, the weight is lifted. Why am I worried about getting back into a game to where Ill be sitting in my sleeper staring at walls, having no real life, and chasing your pay. I think it's time to regain my sanity and realize that time is way too precious

    Many companies don't even look at DAC / HireRight.

    The company I work for doesn't. The owner would just laugh at me if I told him that I got a speeding ticket.

    I now know what a broken record feels like. I said countless times it wasn't a federal regulation, but state by state regulations.

    After 9 years of driving, you're working for the wrong outfits if you have to drive illegally to make a $800 paycheck. You're selling yourself the short end of the stick and don't need to be driving for starter companies anyway. I work a local gig for 8 hours a day 5 days a week and I take home $1260 a week. The safety department at my company is also a joke. It consists of one guy and the only time you'll ever see him is when you first get hired on and he gives you a road evaluation.

    I'm not boasting by any means, just telling you that there are options out there for you that you don't have to bust balls and run hard with.

    State regulations only apply to intrastate carriers based in that state. Interstate carriers are governed by the Federal regulations.
