The widow of an Illinois State Police trooper is suing a truck driver and two trucking companies. Sarah Deatherages husband, Kyle, was struck by a semi driven by Johnny B. Felton on Nov. 26, 2012.

Is it time for "driver's malpractice" insurance to enter the market place? Or would that only encourage more law suits? (as if the industry isn't already targeted enough) But she may well have a legitimate case, but I'll withhold any further comment until the complete investigation becomes official and released.

whether she has a legitimate case against the company is one thing, against the driver sounds pretty open and shut. you knew you had a disqualifying medical condition, you took drugs to treat the condition, but lied about it and continued to drive til you killed someone. unless the information given so far is just wrong (ie. its not a disqualifying condition) hes guilty, period, and deserves to spend a LO-O-O-O-O-O-O-O-O-O-NG time in prison for having murdered a police officer. (i know, i know, its vehicular manslaughter. but when you get in your car or truck knowing you shouldnt due to being drunk, high, or in this case not medically fit, you essentially PLAN on putting everyones life in danger. murder 2 minimum in my book)

This could end up being grounds for much stricter health standards for all truck drivers. It could very well end up that all medical conditions that require any type of medications, while on the road, will automatically disqualify an individual from any kind of truck driving whatsoever.

unfortunately, you are right. the people who govern like making laws far more than they like enforcing them. they dont enforce the gun laws on the books, but get ready for some new ones soon. this is a clear case of violating an existing law (again, assuming the info given is correct), so the answer OF COURSE would be to make some new laws restricting further who can or can not operate a truck.

as far as someone not be truthful about a medical condition i know many people who drive truck who are on blook pressure medicine or have diabetes who use one doctor for there medicine and another for physicals

I think you'll see the Obamacare law that requires ALL medical providers to code and submit ALL services provided to a central medical databank, will be used for driver/pilot medical certificate issuance decisions ... sort of like the way insurers share claims histories with one another when you're shopping for insurance. I don't like the idea of the government having access to all medical records, eventually from birth to death, to use for or against you, but that's what they crammed down our throat and if many [some] are going to actively seek ways to beat the system, maybe that's what we deserve.
So if you get a divorce, or lose a family member in an accident, and become depressed and seek counseling and/or anti-depressant drugs to help get you through a tough time, be aware these sorts of things could be used many years later to potentially disqualify you from employment, gun permits, ammo purchases, etc.EZX1100 Thanks this. -
It will not be the result of ObamaCare.
There has been a move toward this for years. Many drivers on disqualified drugs get two year certificates. The reason, is simply that they do not mention them.
I think it will become a point where all prescriptions will become a matter of the driving record. After all, there are people that cannot even drive a car because of their medical conditions. -
i wish more folks could see what direction this whole thing is going
