Question about a 1099 statement

    From Sept to October 2012, i was driving for a guy as a 1099 milage driver. I ran 10 loads. This was with CRST Malone but i worked for the owner of the truck. This Year i worked for a flat bed company lease purchase, Driving an ex McElroy International Truck, got in a wreck with a train, to make the long story short, it was both of our fault in a cust, yard. No points for me. Then i drove for the guy i was talking about. I have my 1099 Statement from the first company, from the one that im working know in containers, but the guy that i drove from Sept. to Oct. 10 loads over the road, hes giving me the run around. I know for that 1099 the irs can get me for late fees and i heard horrible stories here. My question is, if thin guy doesn't send me a statement of what he paid me for those 10 loads? is there something that i can do? My CPA is ready to do my taxes and this guy is dragging his feet probably because i quit on him in Florida after he and CRST Malone tried to keep me longer than promised. Will appreciate serious replies if anybody can give me a good opinion of what i can do?

    You can file your own and also file a complaint to his states employment bureau. Your CPA should have no problem filling the form for you.

    Mnmovers correct, its the labor
    board that should be contacted

    Use your paycheck info to get as close as possible. AND THEN LOOK UP THE LABOR DEPARTMENT IN YOUR AREA.

    The labor department does nothing in this case, not their job. It is the irs and worst that can happen to him is $250 fine and he never has to send it at all. This has happened to me so i know this for fact.

    Thanks for the reply. After my accident and lost of my Contract with New Line Transport in Florida as a lease purchase, i called this guy from craiglist. He needed flatbed drivers so while my court date was backed up two months because Tampa was preparing for the RNC Republican Convention, i decided to make some money while waiting for my court date. So this guy just has like 5 trucks and he hires drivers. He had no pay stubs for me. He basically pais me through comsheck wire pay in the truck stops. I will call my CPA tommorow because all i did for him was 10 loads which CRST Malone paid him then he pais me as my boss. I know it was not smart to drive for someone like that. If there is something i dont play around is with the IRS.

    You can report him and get him fined and maybe it will speed him up. Or over estimate what you made and you may have to pay in some but atleast you know your covered.

    Thats what im thinking. I kept alot of reciepts. Thats something that i do have.

    Thats good. If you kept the recipts for cashing comcheck your golden.

    Dude check out I. R. S. Form ss8 there r three things u have to meet in order 4 u to be 1099.trust me if u don't pay fuel tolls extr. Don't make payments can't load truck were u want to go u r a Company Driver
