Does anyone know if any trucking company has been challenged on a matter such as this: I received a speeding ticket in a speed trap town, 61 in a 45. Called my company as required. I have done nothing with the citation yet as paying it would admit guilt and I have yet to request a hearing. My company has suspended me none the less. The gutless safety director doesn't have the testicles to call me and uses the dispatcher as his go between. Been there 10+ years and this is how this a88hole treats me! I would think my rights as a citizen of innocent until proven guilty extend into the workplace.

So it seems like you were speeding and got caught, but you're upset because the safety director used your dispatcher (direct supervisor) to communicate that to you. I'm surprised that they put you on suspension, I would think in today's world of CSA that they would consider cutting you lose. Is it just a speeding ticket, or did they get you for reckless driving?

Get a hearing, go to court, settle the best you can, then change jobs.

Suspension is a form of termination. If they don't call him back they have in essence terminated him. If he is suspended until the outcome of his court case that may take some time.
You should refer to your "driver policy manual" and see what it says regarding such violations. That will determine whether you have a leg to stand on when it comes to suing your employer.aiwiron Thanks this. -

Many carriers "policy manuals" dictate that the moment a ticket or warning is issued thay must be notified.

It was defintely speeding 61 in a 45 and nothing else. Just talked to and hired an atty who said his experience in that town is the cops fail to show for the hearing 30% of the time. He will try to get it changed to something else. I am not concerned about the ticketing. However, the company's action of placing me inactive before admitting guilt in court or being proven guilty is a slap in the face. I hate to get into the typical "my constitutional rights" have been violated whine but I always thought we were innocent until proven guilty and THAT right extends to wherever you are in this country...on the street, in your house or in the employer's office!

Like what state this happened in, what state you hold your CDL in. Makes me wonder, wonder, wonder (about stuff that doesn't concern me) -
got to read the hand book of that company. most companys books say if you get a ticket over 11mph u will be fired. alot of this comes down to an inspection report.. thats what the companys really worried about cuz they dont want csa points if u get a ticket without an inspection report it dont go on csa lol

He didn't say an inspection was performed, so why would CSA matter?
