A truck driver has been 'no billed' by a Jefferson County Grand Jury, meaning he will not face trial in connection with a fatal Thanksgiving Day accident on Interstate 10.
The Grand Jury heard evidence against Richard Fernando Kerr and decided to take no further legal action against him. Kerr is the truck driver involved in an I-10 pileup which happened on Thanksgiving Day 2011 in which at least two people died and over 100 injured. His large truck slammed into the back of a car killing Vincent Leggio, Sr., and Debra Leggio.
Although Kerr is cleared of criminal charges, he remains a defendant in a civil lawsuit filed by the victim's children. The lawsuit also names the owner of the 18-wheeler and C. R. England INC.
According to 12News file stories, fog was a factor in the accident.

isn't that that big fog deal in florida the radio was talking about???
isn't the highway patrol the one to be sued. since they kept the freeway open.volvodriver01 Thanks this. -
This is the wreck out from Beaumont TX which I thought just happened in 2012, not 2011. I am surprised because one article had stated the fog had started in about midnight.
The suv may have contributed to the wreck though, esp if they stopped in front of him. I know he is thanking God for the decision. -
I believe the one you're referring to was in Florida on i75 and was due to smoke from a wildfire not fog
-
So they wanted to charge just the truck driver out of the other 70 or so other vehicle drivers involved? Did their slamming into each other not contribute to the fatality?

The big wreck in Florida happened in Jan 2012 on I-75 by Gainsville because of smoke from the marsh fire.
