My husband and I had an SUV we rented for a long trip a few years ago. Hubby was driving and got pulled over in MD. Long story short, he got a ticket for 5 miles over rather than the 15 :0
So I said to the trooper, would you like us to pay that now? He giggled and said, "Oh no, ma'm, you're not that far south!"
What would you have done...

What happens if you DON'T pay right then and there? Get arrested? That's what you want and what they don't want, even in the small towns. See, there's a person that you will have to see that the cops don't necessarily see eye to eye with. The magistrate. He's like a judge, but he handles things when the courthouse is closed. In this modern day of cellphones and satellites, contact your company, let them know what's going on...they will be swarming in to get their property back. It's not like the old days where you have to worry about being stuck in a Mexican prison and no one knows what happened to you.
So, the cop tried to beat you out of a couple hundred bucks. But if he's suddenly looking at going to court, with big corporate lawyers coming from out of town, odds are he will opt for easier prey.Boka Thanks this. -
Is there no provision in the law that allows you the opportunity to go to the nearest public scale to get the weights right? Thats the angle I would have played, seems unfair if that isnt allowed and seeing a judge or magistrate would have changed the outcome I believe. And if this happens on a regular basis I would name the company that you loaded at so other drivers know what to expect. Its not as you are accusing the company of wrong-doing so I dont see the harm in naming them.

Cops don't have anything better to do then pick on truck drivers.Certainly their's bigger fish to fry in Chicago.

With the murder rate in Chigcago you would think they had more to do than they could handle.

To be honest i was bullied into paying the fine, like i said he escorted me to a police station and after he took all axle weights he said i was over 300 lbs he brought me inside a police station and showed me a booklet where there were list of all fines per pound... i paid and left. everything took less than 45 min. -

Well he told me i was free to leave but my truck was nowhere to go till i paid the fine...
Honestly i thought about hiring a lawyer but that would just cost me more money and i wasn't sure if i would win... -
I did tell him i just picked up a load and had nowhere to scale. It was summer time and had stopped at a red light, he was waiting at the gas station and when light turned green he saw that i was heavy (load was 45k lbs and my fan kicked in since it was very hot) because my truck was slow to gain speed.
This did happen summer of 2011 and i never went back there again, i was pulled over on RT 171 which is 1st ave. If you look at the map i picked up load of Washington blvd and made a right on 1st ave, i was half a mile away from I290 -
As with anything in life, if you don't know the rules of the game you are playing, you have no choice but to allow others to interpret the rules for you. The other person is never going to bend them to your favor....more often than not you'll get bent over because they have that badge and you don't know any better when they decide to start making up their own rules.
