DWI Dismissed by the courts seeking a bulk tanker job need your advise

    I was stopped and charged with a DWI while driving my personal vehicle March of 2012. The case was dismissed by the courts July of 2012. My license was suspended for one year due to the stop. I now have my CDL back and am looking for work. I have been driving for 30 years with no tickets or accidents. Any advise on if this is a lost cause or if not what companies to apply would be appreciated. I am a bulk tanker driver with Hazmat and TWIC card.

    Good luck driver, your license will still show u got a dwi. even though it was dismissed. the criminal part was dismissed not from dmv. u might challenge this through dmv but believe you only had 90 days to do so. hope this helps and good luck in your endeavors

    How long have you been off the road?

    if its not on your record and you were just off the bigroad for a year, you shouldn't have any problems. I wouldn't mention it....just show employment history for the time away.

    He just gotta show the court papers to the company and they will look past it he said it was thrown out. When you apply to company's your gunna have to follow through with them don't wait for them to call you

    Not true.

    A ticket is nothing more than a subpoena. It's not a conviction. The only issue the OP will have is lack of recent driving history. If the OP got arrested for a DWI, that MIGHT appear on his MVR, but it's highly unlikely. It would more likely show on his criminal backround since it's a felony. But, it can't be in either if the OP was able to get a TWIC card and Hazmat.

    I am going to check my driving record. I have been off the road for one year. My license was suspended as a result of the stop. The problem is most of the applications ask if your driver license was ever suspended and then why. I applied to one prior employer and they interpreted the court dismissal of the case as a downgrade to the charge even though I provided the court records showing a dismissal.

    This is crap. Guilty until proven innocent. How can the DMV/state justify taking a person's license before proven guilty. Sue them for damages.

    the hazmat and TWIC were done prior to the stop and are still current. I did have one recruiter tell me take a refresher course at a driving school because I have not driven a tractor trailer for one year.

    One question and you can only answer if you want...were you driving and drinking...makes no difference what the courts did , a good lawyer and enough cash can get you out of a lot of things...I'm not accusing you or anything , but if you have a 1 year suspension I'm assuming that you refused a breathalyzer test.....You have 30 years with no tickets or accidents? Why would you make such a terrible choice , you had to be aware of the possible ramifications of being caught....you may have to wait for a spell to see if some one will hire you....

    What state are you in?

    When you get an H6, if the DUI is on there, you might be able to have it "purged" (depending on the state you're in)
