The only problem drivers on this side have is that even though the fees are included in the cliam the attorney still told us that we are still looking at 35 percent per driver of whatever is recovered. With Brian already selling off equipment he may be worth nothing in the end and if they can't recover enough money then we have to pay for all legal fees. That came staright from attorney. The thousands he owes our family would be wonderful to get but if not enough is recovered that could leave us with nothing in the end. It is a known fact he is having people drive all his trucks back to Jessup and from there he is selling them. In all honesty if he is doing that you know he is going to sell them to a family member or friend for practically nothing just to re buy when all is said and done and smoke clears. Obviously he isn't that stupid or he wouldn't have gotten away thus far with our money. Not at all are we saying its a bad idea just got to do more research and see what's the better plan in the end is all. The feds and irs and government all are investigating him so with all that something will be done regardless. Still just up in the air if we want to take more chances on losing more money in the end. Also the attorney told us that this is ONLY for 401k. There is no part for wages or any fees for returned checks or bonuses owed. Well, you are looking for something for nothing. that's not going to happen. When I talked to Mr. Blau, he said that the unpaid wages will be added to the lawsuit. Also, Brian can sell off all his assets, but that will come back to bite him. Hiding your assets to avoid a lawsuit is a crime. You guys have to trust the legal system. There is no other way to get your money back. You will not find any lawyer that is going to work for free or give you ANY guarantee that this will turn out exactly the way you want it to. Please, stick with this. I am afraid of loosing it all too, but I also know that there is no other recourse but through the courts. And IF it does end up costing some of your settelment, isn't that better than nothing at all? Brian has NO defence for what he's done and I am sure we can win this thing if we all stick together. one other thing to think about before I turn in for the night, if the IRS and the PO get to Brian first, they will clean him out. They don't give a hoot about what Brian owes us. if they get him first we might walk away with nothing. I am going to talk to OUR attorney monday and see when we can get this thing into court or reach an out -of -court settelment. We WILL get him

 

You're right. We picked up a run from a contractor that was shut down by the IRS and the PO. They got first dibs on any cash and assets. The PO ended up terminating the run but we still have a driver here that came over from the shutdown contractor and he still hasn't gotten his money.

what i dont understand is why brian wont sign off so we can get are 401k money out so we can use it till we find other jobs.

sign off on what ?? if there is nothing there whats to sign for my pay stubs say I have $14,800 there ascenius says I have a $ 000000 balance after 2yrs you can't sign for something you mishandeled or blew or lived way beyond your means and we know he does that well!!!!!!!!!
