I get payed 1099 and if I get my corporation Im still going to get payed like a company driver...no im not trying to lease a truck...I got to wait for Monday to talk to the company's accountant to see what's really going on since she told me I got to pay 400 for the application and that is not an option...I dont see why I need a corporation if im only a driver I don't owned or lease the truck...thanks for ur comments/opinions. .n I dont want to put the company's name out there my bad

Exactly right..."Run don't walk away from this stuff.." You said they give you a 1099 and pay you as a company driver but.....with a 1099 you are considered a contractor not a company driver. They may call you a company driver when it is convenient for them but when the IRS comes knocking you are a contractor. You are responsible for all your own taxes and all of the social security tax. I don't see how they can force you to become incorporated but I'm not an accountant. I would certainly get away from these guys as quick as possible. Shady doesn't begin to define this operation.

whooo driver put on them brakes 1099 your a contracted driver not company driver and you do know that you will be paying taxes on all that you made hope your making alot per mile and saving all receipts for anything you buy when driving. sounds like mom n pop trucking co is trying to pull a fast one one the fmcsa. company truck but listing you as an o/o

They will absolutely have a paper trail on their requests for company drivers incorporating. That's number one, and if they are identifying them as employees..ugh I don't know where to start..lol it just doesn't make sense. The guy has no truck,no ins,no means of incorporating what so ever.

There would be nothing illegal about it if they pay you as a contractor, which means you would receive a 1099 instead of a w-2 form at the end of the year. Millions of people are paid this way, most sales jobs are paid this way. Normally route drivers for companies like Snap-On, Mac Tools, and Cromwell Tools are all paid this way. Those are companies with a well established history of treating their people right. If this company isn't like those I mentioned I wouldn't trust them and I would just seek work elsewhere. There are a whole lot of other concerns when you incorporated/contracted/self-employed to talk about in just one post as well.

It's also well established if you have no skin in the game, are told where and when to go, especially forced dispatch, you are an employee.

hmmm. I guess we are on same path,different trax here...of course incorporating is legal. I've been incorporated for years,it's just that they are wanting "company drivers" to form one with being under the impression of STIL being an employee...
I suspect this fella has all employee benefits and has no interest in a 1099 whether its to his name or a corp. There is something coming down the pipe( hearsay so far) that IRS would have an easier job if O/O would incorporate... Personally I can't imagine not doing it as an O/O but makes zero sense to attach a corp to an employee...( still scratching head) on that one. But I have all the faith in the world that someone smarter than I will come and explain this...without a doubt...lol

See post #11 . He IS 1099 and the carrier wants him to pay them $400 for the application to incorporate . The IRS and FMCSA really need to look at this carrier
