Medical Card

The state DMV can down grade the CDL if they choose to. They're all going to require that you have a medical card with you CDL or your license is no good. It used to be you didn't need the card unless you were operating a CMV. But that's all changing now. I'm not sure but I believe if you're deployed you might have some exemptions. I'll check it out and get back to you.

 

Many states do it now . My medical card expired February 28 and they mailed a notice of suspension February 28 . I had already renewed the card so I faxed them copies and they faxed me a copy of reinstatement .
In your situation they should reinstate you when you provide a new medical card . If they don't contact your state representative .
This issue should be addressed as it affects many veterans in the military but it would have to be done on a state by state basis .

 

Here's some info for you. Starting back in Jan 30 of this year they now require you to submit a current DOT Medical Examiner's Certificate to obtain a "Certified" medical status as part of your driving record. You'll also be required to keep that record up dated if any changes occur. Fail to do so you'll become "not certified" and may lose your CDL. That's what it sounds like is happening to you.

For the military, however, there's some hope. It reads like this, the military is allow to renew before deployments. That's just one item to remember. It goes on to talk about reserve units. They will allow reserve components whose license expired during active duty outside the U.S. to be good for 60 days after the date of release from active duty. They need to submit a copy of their orders along with all the other paperwork when they get back to get the CDL renewed.

If I were you I'd write to the NC CDL people with a copy of your orders and explain what has happened. They just might let you fall under the reserve part of the new laws. I don't think it will show up as a suspension . Your license will be still valid , just downgraded . Maybe your former employer will help you . I'd still contact your State Representative . Maybe have your wife contact local tv action teams or start a Facebook petition . Bring this nonsense to public attention .

 

I'd still try to use that reservist clause and just go in there when you get home with deployment orders and ask for a renewal. If you can't you'll have to go through all the steps like when you first got the CDL. I do not believe it will show up on any record that your CDL was suspended. It's just a CDL that was voided because the state feels you lacked one part of the validation. I'll call your DMV tomorrow, if you like, and ask the people at the CDL section. Are you in fact a reservists? I don't know if you've had any experience sending paperwork to a state but sometimes you will not hear a thing for many months. I will not call unless you say it's ok.

 

Mirs270- As I stated in one post, you should ask your JAG on duty. and tell him what you stated. Tell him it is bothering you a little and I am sure he will help. He is there for this purpose. From experience I know tis will help. Mike-Z

 

if you deployed oct 2012 and it expired dec 2012, you could have renewed before you left. IF you didn't renew it ofcourse they are going to suspend you. They cant have a driver with no recent medical card driving around.
