Just started a new local job and they have an interesting practice, make deliveries and when you are out of your 14 hours they send a company vehicle (non-CMV) by a driver who drives your truck back to the shop and you drive the non-CMV vehicle back to the shop, unload your truck, usually less than an hour. Is driving a non-CMV (company vehicle) after 14 hours legal? Is this logged as On Duty Not Driving since it's not a CMV? This is an hourly job and do get paid for all time I do any work for the company.

    Not logged at all.

    Off duty.

    While in the car.

However, on the dock, on duty not driving.

I would think this alone would make it not only shady but also illegal. For clarification, you would be unloading the same truck you drove all day, correct?

Yes, I would be unloading the truck I drove all day. I know that you can work after 14 hours, just not drive. Since I am getting paid to drive the non-CMV it has to be logged, just not sure if it's legal and how to log it.

If the company is requiring you to log the car, then log it the same as unloading the truck. On duty, not driving.

That's what I was thinking. On Duty not driving. You are just like the Dr who has been in surgery for 24 hours when he drives home except he doesn't have to log anything. The rule is you can't drive a CMV after 11/14. You can work as much as you want to but have to take a 10 before driving CMV again.

They are making you believe you are legal, but you are not. Work is work is work is work...on duty is on duty is on duty.... But that's a nice lil trick they tried. Tell them to raise your pay bc you are not allowed to work anymore than what is legal . :biggrin_25525:

He can legally work 24 hours straight if he wants, he just can't drive a CMV after 14 hours from the time he goes on duty and must take 10 hours off-duty before coming back to on duty-driving in CMV.
