Question about trucking company policies for being drug free

    From my understanding the Dr didn't share anything. The dr instructed him to write something on a form. The OP still hasn't said what he wrote and what kind of form he wrote it on. I'd speculate that it was his medical card long form or form the company sent with him. The form was filled out and returned to the company. I don't think the OP has anything to worry about. Move on to the next company and keep your mouth shut! Certainly don't tell them that you were let go from a previous company because you told the dr you were a pothead and a drunk!

    From what I interpret from his post, he was instructed to write down his past pot use on a form and recheck some boxes. That form is part of the patient-doctor confidentiality UNLESS it's a disqualifying factor ... which it isn't. Even if it was something else, ANYTHING he conveys to his doctor is confidential with the sole exception of a disqualifying factor. Now, if it's as you speculate, that he wrote that on his form going to the employer (of which I didn't consider), I agree, next time, keep his mouth shut and roll on to the next company. If this is the case, the doctor is unethical because as a company physician he knows this would screw him.

    Oh man... too honest :( you shouldn't have told them anything if you were clean and knew you wouldn't relapse.

    He just recently quit and old habits die hard.
    It would be real easy to relapse after being confined in a truck for days or weeks.

    Read this carefully,

    HIPAA does not - repeat does not cover DOT exams. As much as people want to think that they have medical privacy under HIPAA, they do not because DOT/FMCSA regulations are exempt. The clinic and the doctor has an obligation under state law to keep things private.

    They have an obligation to share that information with the carrier if it is known to the clinic or examiner.

    IF this person got into an accident, and the lawyer for the insurance company or a victim decided to investigate the person and PAST dot examines, drug tests and so on, this information is on file and obtainable. Because we have to keep account of all of our jobs on our applications, they can use that against the driver.

    What career?

    It seems the OP is trying to complain something about out of his control because his activities seemed to be more important which he knows is illegal or damaging to others if abused. There is no right to drive a truck and this should be stressed. Like others, I don't want people who can't control themselves behind the wheel and one reason why the more I read the stupidity of asking about drug testing or how people justify drug use with their "career" of driving a weapon leaves me more and more asking why isn't there a long term hair testing and more randoms of people.
