Marten Detention Pay - Ripoff

    Exactly. Your 14 hours expiring only means you can't drive (over 5 MPH for over 1 mile). Doesn't mean you can't still be on duty - and being paid.

    The driver's 14 hour clock expiring is irrelevant. He should still be paid. Both the Marten and the company unloading you are expecting you to drive off when they are done.

    If you're 14 hr. clock runs out you won't be doing any other loads for anyone else. If the dock you're unloading at makes you leave when they're finished then you WILL be leaving. Neither the company unloading you or Marten can move the truck by remote control which means you are still in control and driving the truck and therefore deserving of the full amount of detention pay/

    I spoke to the legal department at OOIDA, explained the situation and they agreed that it's a ripoff. Being generous to Marten the lawyer said, it's at least a misunderstanding of the rules of pay. Drivers can be paid after their 14 hour clock expires - the just can't DRIVE.

    According to him, here is the problem: OOIDA calls Marten for you and they find out you're agitating against them. They fire you for some meaningless nothing - with cause - and then you're screwed.

    I'm interested in doing a class action because this is SO blatant and obvious. If memory serves, trucking companies must keep all records for seven years. If I was a lawyer that would look like a slow, obvious, fat target for litigation.

    Anyone know a law firm experienced in class action litigation? Trucking litigation?

    Your argument fails because a driver's 14-hour clock is none of the receiver's business, but even if it was, it isn't wise for carriers to reward incompetent receivers with lots of free detention time.

    C'mon Man, it's time to join the stampede. What you need to do instead is, admit you made a big mistake ever hiring on with Marten in the first place, do a more careful job search this time, and find a better company to drive for like so many other Marten drivers have done over the past five years.

    The more I stay in the industry, the more I think they are all the same. Leaving Marten wouldn't help anything. Just change one set of crooked rules for another.

    The only solution is to own your own truck (own outright, not "own" with a huge lease payment).

    They are all the same crap. It just depends on how much you want to eat and what you will get out of it. Anyone know WEL Companies? Are they a step up or down?

    So refuse to move the truck out of the dock and let Marten eat a tow bill. They might change their toon if they have to pay enough 800 dollar nuts for their stupidity.

    I HV ONLY BEEN WITH MARTEN 6WKS..I DONTVKNOW WHAT U GUYS R TALKING ABOUT..I GET GREAT GREAT MILES..I GET MY DETENTIIN PAY..I AK FOR IT NICELY..I ALSO ASK FOR. ,po# SO I KNOW I GOT IT..I HV WORKED FOR A FEW OTHER COMPANYS THAT PUT A REAL BAD FEELING IN ME ABOUT TRUCKING...BUT LOOK IM ONLY WITH MARTENS 6 WKS SO FAR..AND MARTEN IS TREATTING ME REALLY GOOD..A GREAT CHANGE FROM OTHER COMPANYS I HV BEEN WITH...I HOPE THIS KEEPS UP..CAUSE I AM MAKING GOID MONEY,,I STAYED AT ,USX. TO LONG WENT BROKE THERE ...ANY QUESTIONS ASK..NO BS HERE ...THANKS.
