HIV, criminal record, licence suspensions

    JBS Carriers uses Roadmaster, which is a private school. They front the money for the school. Try applying with that company. Your driving record is the big probem though.

    I'm curious how its discrimination for a company to not hire somebody if their HIV positive, but somebody who has type A diabetes is fair game. It shouldn't matter what you have, if your a potential health hazard on the road, you shouldn't be on the road. Period!!! :biggrin_25513:

    Hey I give him kudos for atleast having the guts to come out and tell it like it is. I can tell you this you won't be pulling produce or meats where if something happened and u got cut they would destroy that load asap. Your record may or may not put the screws to ya all depends on the company. Give it your best shot or find an O/O to drive for. Good luck to ya and good job coming clean with everyone.

    Not giving someone a job because they are HIV positive as the reason is discriminating against them.
    As it would be not giving someone a job driving a bus who is child molester.
    It would however be a legitimate discrimination against the child molester I assume we could all agree.
    How exactly is a HIV person a hazard on the road?
    If there is a legitimate case to be made then I could agree that discrimination could be warranted.
    I know how Type A diabetes can be a hazard so I understand the logic.
    As for immoral values , HIV is an equal opportunity disease and the virus does not care how moral a person is.
    The innocent and moral (If there are such people) also contract the virus.

    I was forced to learn more about HIV/Aids and the difference because of the high prevalence in the trucking industry in Africa where I work.
    I now know that if HIV positive people are on good meds , eat well and generally live a healthy lifestyle they are as a workforce indistinguishable from the HIV neg population.

    Well, thats just it, my HIV status is not really a hazard over all. I mean in certain cases sure it could be. Some of the meds, especially meds from years past could be a problem, but I take a once a day pill and I have NO side effects. Its actually why the drug companies developed this pill, because it meant to be agreeable with the patient. Today my health is great, I actually feel better than I ever have. My immune system is wicked strong, and every time I see my doc, its gotten even better than the last time I saw him. I'm at a point where I only see my doc a couple times a year. So long as I stay on meds, I will be in great shape to do anything! Just like a regular person...LOL:biggrin_25523:

    Well there are two different issues, HIV positive is not a driving problem, Diabetes is and is covered under FMCSA regulations to mitigate problems of passing out if there is an uncontrolled event like low blood sugar. IIRR HIV and the related problems do not have that many issues with sudden sickness or uncontrolled events like in Diabetes.

    The discrimination part comes when the company openly admits that they don't want to hire you when you disclose the issue of being HIV positive where if there is a need to mitigate a possible issue with hiring someone with type one diabetes, then they can do so under the FMCSA regulations.
    But he isn't if controlled and he maintains his hygiene properly - thats the rub with all of it.

    Yes it is. And I think though, after having gotten so many responses from folks here I feel confident I can get a job. I might even be able get a job with a better outfit if I am able to explain my record to a recruiter. I only have one suspension which comes directly from a driving incident, and although it was a big accident with a negligent driving charge (which is a crime) it was 10 years ago. The most recent suspension was from a civil matter from an accident which took place in 2007...I didn't lose my license for it because MA is a no fault state, so the insurance company sued me civil court, I wasn't even living in the area and since they didn't have my new address they are allowed by law to proceed with the case without notifying me. Since I wasn't there the judge ruled against me, and as an additional punishment, (and so they could eventually find me) they suspended my license. I found out from my last speeding ticket on November 1 2009. At that time I cleared the whole thing up and the speeding ticket was filed without a finding in March of 2010. My over all actual driving record (in my opinion is not bad) I only have 2 speeding tickets total, and then the 2 accidents.

    All said I do understand though that a record is a record and in the eyes of many its black and white, including for many companies. I am willing to pay my dues and prove my worth, even if its with an outfit who some might consider to be to rough for them. I stated before, i'm rugged, I can take the heat!

    Do I think any company should refuse to hire him for his status? No, not at all. If he is able to do the job they should hire him.
    Now, do I think his trainer, should he need one, be informed that the person about to climb into the truck, sleep in the truck etc with him has this disease? Yes. Let the trainer decide if they wish to spend hours upon hours stuck in a truck with someone who has HIV. It's not just the OP's rights, I believe it is the right of the trainer to be fully informed of what is going on. Let them make the choice.
    Agree with it or not that's my opinion. While the OP has the right to work and not be discriminated against, I have the right to refuse to allow someone with this, or any other infectious disease, in my truck with me. After all its my health, safety and sanity I have to watch out for.

    One last point for now. I think I will actually keep this account going. I had said before when I got the info I needed I would just delete it...But I am thinking I can remain anonymous, and if something else crops up in the future I can come back and ask you guys what you think. I am very surprised and happy to have received so much help in getting some direction and clarity here.

    I am confident I will be able to find a job and begin to navigate my career. I will keep you posted as I make progress.
