It is one of the first pieces of evidence gathered. If they don't get it, the lawyers from the other side will request it in the discovery phase of the trial. Yes, it is legal for all parties to have it.

the whole point is don't give up the information when you don't have to. Why would you just let them look at it. When you speed, do you look for a cop down the road, pull over and tell him your speeding? The information on my phone is mine not for law enforcement, if you want it, get a warrant to search my phone. Don't just let them look at it. Its not about don't do the crime, its about your rights.

I have never been asked for my cell phone when I have been stopped. If an officer asks, then I want to see his warrant. If not, then he has no right to check my cell phone. It isn't that I have anything to hide, it is that it is none of their business. As long as people give up their rights, the police will take mor of them. I like my right to privacy.

If pulled over for speeding... it's unlikely an officer would be interested in your cell phone, or have cause to request it.
On the other hand, if said officer see's a cell phone at your left ear while tooling down the road, or perhaps witnesses erratic driving... then I think yes, he can inquire and/or request to see your phone. And as CDL's and Cell Phone's do not mix well [383.51c, 383.91e, 392.82]... the implied consent probably covers the officer's actions.
The authorities are cracking down hard on cell phone violations... such as a second (texting, I think) offense, your license is gone for life.

Are they aloud to...yes. Is it right? NO!!!!
What if you text hands free with siri. You can tell her who you want to text and the message without ever picking up or looking at your phone if using bluetooth. A cop would just see the text and assume you actually were typing on the phone. It also sucks that if your not a flault, you my be determined more at fault if your on the phone even if using a bluetooth.gearjammer1978 Thanks this. -

i'd like to see that regulation that states WE ARE GOVT. PROPERTY. cuz if that's the case. i'm going to start demanding govt. pay and all the perks and benefits govt employees get.
