ok you have the right to text on your phone
not wear your seatbelt
not use a Bluetooth
not conform to the HOS
all because your an American
happy now?
I will continue to believe that the government steps in because people namely us
do stupid things that cause the laws to be made
the government pendulum swings too far and the laws don't serve the intended purpose
but they all start from poor behavior of the masses
After a crash, should police be able to look through your cell phone history?

People here seem to think they do. Go arrest a cop and see what rights you have.
-
after that cop beats you and states you attacked him

I used to work at a bar saw lots and lots of arrests and the final tally was......I know my rights-0 Cops-10000000

Yep. Got it. And it is sad that a majority of the public thinks the same way. Whether I am doing something or not, any new law or regulation needs to be questioned. With so many laws and regulations already, even when you think you have nothing to hide, you may still be violating something. And that something may have some real dire consequences. There are far too many laws and regulations now. And the truth be told, one of the reasons for so many is so that government can "stack" violations just to make sure they get you for something.
Now to the original issue. If any LEO wants to see the Cell Phone. I have no problem showing it to them, in good morr2fab fashion. But there is a twist. My phone is always password protected. If they want see what I have been doing, better get a warrant to compel me to reveal the password, or head on over to the local university and get a hot shot in the computer department to hack in. Otherwise, mr. LEO, you just aren't going to get to see what I was doing on the phone. You can see the phone any time you like, but seeing what I have been doing with the phone is another story. And all the while he is fiddling with it, it will be recording his every word, and those files are automatically, at predesignated time intervals, sent to my email so even if they confiscate the phone, the files will be available. they would need the password to stop the phone from recording them or turn it off. If they have no idea it is recording them, which they will not, then it may be some time before they figure it out.cetanediesel, Joetro and bullhaulerswife Thank this. -

The office looks at your phone and determines that you were on the phone when the accident happened. the problem is that the officer is using the time of the call reporting the accident as the time the accident occurred and does not realize that you reported it so the accident is now your fault.
Another problem is how does the officer know the exact time of the accident and weather you were using blue tooth or the speaker,
