Questions for specific compliance to my situation.

    Hello, My name is Don. I found this forum through a search for compliance to HOS rules. I've read just about all of them, and can't find what I'm looking for. So here is my questions.

    We are a towing and recovery business. We tow cars and trucks from breakdowns / accidents (some times at the direction of law enforcement) to (our yard) shops. Our drivers (my self included) are on call 24/7. We are required to be at the shop between 8 and 5, Monday thru Friday and available on call the rest of the time. 90% of everything we do is within the 100 mile air radius (including some stuff in neighboring states).

    1. Do we have to keep log books in the truck?
    2. Our invoices have blanks for time started and stopped (as well as mileage run on that call), is that sufficient for time records kept at the office?
    3. Does state lines have anything to do with the 100 mile air radius?
    4. Are we required to show or is time sitting in or working in the office/shop as on duty not driving?
    5. Is towing considered drive-away/tow-away?
    6. How do we fit into the HOS rules?

    I know this may be a lot to ask at one time, but I have not found any answers from any law enforcement personnel that fits. Most say one thing, and then someone else says another. You know how it is.

    By the way, I quit trucking the last time when the HOS rules changed from the 10-8 rules. And I have not kept up with any HOS rules since then. Locally, no one cares. It's just become a problem in neighboring areas.

    Back then, it was easy. Now I'm older and my give-care-button is touchy.

    Just curious are your drivers carrying CDL-A ? And what are the weights of your vehicles? And do your trucks have MC#?

    If the tow truck is 10,0001 lbs or more all the same laws apply to it as it does a big truck. Even if they claim the local exemption, your company has to comply with Part 395.

    Per Diesel Bear's post from 2011....... And what happened to him? Moved on?

    We have everything from 4 ton to 50 ton tow trucks. from 16 k to 60k pound tare weight wreckers. No on the MC#s, but yes on DOT number. When we cross state lines, which is not very often, I get just a trip and fuel permit. And yes all the drivers are cdl-a
