Non CDL Driver in Freightliner FL70 causing accident

    I have a CDL and know the laws. I was hit by a Penske 2012 Freightliner FL70 last year. The guy pulled out and hit me because he wasn't an experienced driver. He works for a company who put him in that truck that morning. He has a class C Drivers License. This all was noted on the police report and no one was found at fault nor was he given a ticket for not being qualified to drive this vehicle which would also make him uninsurable and no DOT Medical card. I was unable to tell my side of the tory for the police report because i was carried away in an ambulance. My back has been in bad shape since that wreck, an MRI was done showing I have a herniated disk in my back. I can't hold a trucking job because I can only drive 4 or 5 hours before my back is killing me. The attorneys in the area here won't touch the case. Does anyone know of a great personal injury lawyer in Texas who could handle it? Being a fellow truck driver, none of us want someone driving a truck who is not even qualified to drive. Thanks for any help anyone might give me.

    Can't help you with the lawyer, but a couple of things fyi. If it was a 2012 its not a Fl 70, would be M2 106 and some are under 26,000 and don't require a CDL. If the LEO didn't issue a ticket assigning blame, going to a tough one to win.

    I have same disk issue and still drive. I had back surgery and so on yes I get pains after sitting for long stretches so I stop get out walk around and it helps. I have a disabled rating and so on yet I still drive. So I don't understand why you've waited so long to try to find a lawyer. I'm just saying seams funny.

    Like I said I can't get an attorney here to take the case. The truck that hit me has air brakes so is he not required to have an endorsement?
