Okay Taterchip, as a former attorney who specialized in business law, let me say this and it's not an insult just a observation. You need to really learn more about this business because your not well equipped to be a I/C.
First, Panther handles assisting Fleet Owners with finding qualified Fleet Drivers because at the end of the day, it's Panthers client base who is being served.
If you have an agreement with a Fleet Owner, meaning a operating agreement, formally in written form, than your issues are with the Fleet Owner. If your agreement is with Panther and its again in written contract form, then you may have issues where Panther is accountable.
From where I sit, your suit against Panther will never go anywhere and here is why. First, in order to file suit against any employer, you must first go to the US Dept of Labor, hours and wages division and file a complaint. They are going to ask for your contract agreement which is supposed to spell out your compensation per mile or per hour or percentage of line haul pay. Then your going to have to show log books that have dates that correspond with time periods of non payment.
There will also be other documents you may have to supply. Once all is in order and they see validity, then they will initiate an investigation, and it may take 30 to 90 days to resolve.
Now if your the only driver they didn't pay out of all the drivers they have, then your going to be against the ropes to prove you didn't do anything against your agreement that caused non payment.Criminey Jade Thanks this. -

It's tater chip. I hate to dump on all of you ( SMART ) people. But you are wrong. I sued the Fleet owner and won. Court costs, Legal fees. Interest on back pay. and everything else I asked for..Panther called me. Panther recruited me. Orientation was at Panther in Ohio. Panther did my D.O.T. physical right there in their building and panther issued me a Panther I.D. Card. And you think Panther had nothing to do with it??...Yeah,,,,Right...Maybe you are not all as smart as you think you are.

It seems to me that everyone was saying you had no case against Panther and that it was the fleet owner you would need to sue.
Apparently you just read into the posts what you want to see and not what is really there. -
I think there is also an issue of the driver doing his homework and asking about the owner, not just taking the word of the company. No matter who is 'at fault' from the driver's point of view, it is the driver who makes the decision to sign on with the owner, no one forced them into the seat. The disconnect in this case is the driver should have asked for other driver's names and numbers as references - a common practice in expedite. While at the same time one can blame panther for their lack of work but overall this is an issue with learning what their customer's needs are and where to position the truck for the best opportunities that they can come up with. In a related helpful hint with panther, there is always a load board like getloaded that panther will accept to deal with the back end stuff to keep the truck moving, which for the most part there isn't many excuses that a driver can make that they can't make money.

Unfortunately, many here seem too beaten down to support you--even after you won in court. If drivers don't fight back, the megas win. Panther was an end-beneficiary of the work you did. And is in a position to require that you be properly paid. Not just brush you off with a shrug. What drivers forget, I think, feeling it's just too much time and trouble to fight back is that it's time and trouble for the mega, too. Congratulations are in order.
