got screwed by company firing me while on workers comp

    It is misconception that you cannot be terminated while on workmans comp. I've seen a few companies do it.... A perfect example is working a route with permanent light duty impairment, you can't expect company to keep you? Permanent light duty shouldn't fall on the employer's welfare/charity... that is decision for/by insurance co. and for most part what they (insurance co.) say's goes. NOT saying its right, just what I've seen.

    THIS is NOT to say you should have been terminated, only your own legal council can advise on that... But be #### sure your company had its own legal council telling them if/when to get rid of you, even if only through their insurance co.

    ..fired you? Didn't take care of surgery? Lol they're so screwed! But only if you have a competent attorney. It's really just that simple.

    WOW, don't know what to say, But, One thing I might do, I would see about getting all copies of paperwork from workman comp, company, and doctor, Maybe your not being told the entire truth by one or more involved, I don't think workman comp can just stop your claim, not sure but this would have to be do by your Doctor, (I'm not sure on this), but see if you can get all this together and give it to your Attorney, Best of luck

    Did they put you on light duty and you didn't show up? Maybe the comp doctor released you and you/your doctor said no? Maybe you refused to use/agree with the comp doctor? To drop the claim there is more to the story than told.

    WC and company said light duty in middle of march til middle of April they sent me home told me not to come back til they tell me 2. They were watching me and asking questions on sky. Then they were trying 2 get me 2 do things I could not do my doc say no climbing , squatting, standing , sit down only. All I no I was told by Lawyer that I fired that wc went before arbitrator 6/22/13 he asked if wc.if they were still paying me they said yes and some how my Lawyer that I fired told me I had 2 do what the last ime said I had doc apt 2 give the ime 2 doc report on 7/08/13 WC cut my benefits off 6/27/13 without letting me try my doc said physical therapy was just gonna make my injury worse I went 2 give sessions my knee doubled in size by 2nd week in July I was told by Lawyer I fired. He told me since I didn't show up 4 duty after they cut my Comp off I WAS FIRED. I believe my new Lawyer is gonna eat that company alive I have surgery 10/10/13 new Lawyer say that me going ahead with surgery on my own will prove 2 WC that my doc was right and there ime was wrong I was put in middle my doc refuse 2 do what they say and WC refuse 2 set me up with their doc so I can do what they said so I'm stuck with no money and knee jacked up the Lawyer I fired had Wc thinking I was trying 2 be hard but I wasn't it hurts me 2 walk 3 feet and my company saw what I was going they when I did go 540miles 1 way just 2 do light duty my company was cheap I was getting paid $13 a hour 40hours a week then the company had 2 pay 4 my hotel room and WC still sent me $60 this is why they sent me home
