    Warning to all truckers- check the state of your corp. Office and all other terminals they have. If your are injured and go on work comp. In some states you cannot sue the employer for their part of your injury. My injury was caused by lack of saftey equipment that had been requested time after time. As a result i have had 2 failed shoulder surgeries and cannot lift my arm over chest high,and unemployed because my case has settled and my employer has no position for me. Fyi-research your lawyer completely before you sign any contract

    wok cover is just a legal version of dictatorship...i hate it Ive been there 4 years Gr ..they will workcover you over ooops sorry i meant screw you over lol..

    I bet your office is in a right to work state or work for less this is a big right wing thing as uasal American worker out more cheap labor in

    It depends on the companies lawyers,

    and the hospital's billing

    I broke my foot, told them in 8 hours,

    didn't get a dime,

    and stuck with hospital bills.

    but had better luck the next time on a exhaust fumes claim,

    denied by state of Ohio went into collection

    ($5000.00)

    and collection agency got Blue Cross to pay.

    Don't let trucking companies and insurance companies jack you around because each will try. Each state has a Workers Comp Board that protects the worker. I had a problem once with my company refusing to file and the bills not getting paid. I contacted the board and they threatened them with a $10,000 fine. Needless to say the ball got rolling and they took care of me.

    Your problem sounds more like a shady lawyer that got paid on the side. What state do you live in? Did your case go to court or did you settle out of court?

    Yes the lack of safety equipment, if true, is a work place/injury issue, but he still CHOSE to do the work. No one can for force you to violate rules/regulations or work in conditions you deem unsafe without the proper precautions taken. But if all the proper safety equipment was there and being used and was injured that is a different story. We don't know the full details though of what actually occurred. Like others have said it is possible had something to do with a shady lawyer or someone being paid off.

    What was the surgery procedure ? Why was it a failure? I'm about to go thru the same thing,ugh!:biggrin_2552:

    1st operation was a standard run of the mill rotor cuff repair. surgen failed to notice that I had pulled the bicep muscle off the bone completely and 85% of the shoulder tendons were torn completely also. So after 6 months I finnally got him to order another MRI, (Im still on pain killers), he looked at it turned to me and said that the surgery didnt take and there was nothing else he could do.Under work comp I cant sue him either! 2nd surgen said all he could do was try to relieve my pain, anything else would be a bonus. surgery took 6.5 hours and now 11 months later, the pain is gone down 90% and I can raise my arm chest high only. ADVISE YOU to not go with a large medical group. Find a ! doctor office with a min. of 10 years in that type of surgery,that will talk to you 1 on 1
