02/14/08, Went through an existing accident on hwy 22 close to sisters oregon, roadway was clear & dry up unitl this point. Rounded curve in roadway, road was ice, car overturned on my left, driver in front lost control into snow bank to my right, semi behind me also jack knifed into right hand snow bank. I avoided brake use, guided my truck between overturned vehicle & out of control vehicle bringing my truck to a safe stop without any damage. 3-days into investigation, JB HUnt already had in my safety file, which was clean, preventable accident, lane change & side swipe. Appears young kid in a company car has changed his story, claims whip-lash & that I caused him to lose control. I received no citations from oregon state police. I was cleared & told I could leave by the first sherrif at the scene. I was warned approximately one-month earlier that JB Hunt Safety will always try to find a driver at fault in any accident. If you value your safety record, stay away from JB we are on the Hunt against you.

What did you stop for? You said you didn't hit any other vehicles, right? Should've kept going.

This sounds like the young guy in the company car tried to lie his way out of responsibility for his own wreck, and since you were in a truck and nearby, he now has a plausible excuse.

Yeap, you should have kept on keepin' on. It's so bad on the road now you have to use on-board cameras to film everything going on around you. The world is full of liars, is it not? It's actually even worse than this. Those who lie are believed to be the tellers of the truth, while those who are honest are made out to be foolish liars. Time for some powers, be they mother earth, Allah, the Lord, whatever, to come along and sweep it clean.

Legally, no, but since JB Hunt is a non-union company, and with the "dumb kid" in question being management, he is now in the very convenient position of being able to blame the driver since management personnel can do no wrong.

Well I would get a copy of the police report and ask for a review. If he was sideswiped there would be marks on your truck or trailer. I dont think they can put a preventable on your record on just somebody's say so. I would be doing some investigating.

Personally, I think you did the right thing....what if the kid had claimed you had done damage and you had left....then you would have had a preventable AND leaving the scene of an accident......better to fight the preventable (or try to) than get caught in the mire of leaving the scene of an accident, could have landed you in a whole heap of worse trouble.

I think they can, since it's done constantly to people's DAC reports.

I was recently terminated from J.B. Hunt for 3 calls to the Safety Department from the 800 number on the back of the trailers in 2.5 yrs of driving. Of course I disagree with all these calls as anyone can anonymously call in on a driver and no matter what, it goes on your safety record. On my safety review there were two that safety agreed to take off, one I was under a FEMA Load under police escort, and the other I was not in the same state at the time of the report. However, J.B.Hunt has now put on my D.A.C. report that I was terminated for violating company policy, so they can try and avoid paying unemployment benefits and making it almost impossible to gain employment with a reputable trucking company. However, I am a bulldog and will not give up on hiring a attorney and fighting them for both unemployment and getting this undocumented information removed from my D.A.C

You might want to stay clear of J.B. Hunt, Inc. This should be illegal and I will keep you updated on my progress.
