co telling me i dont have to log driving in city

    yeah-just hate to keep job hopping-getting ridiculous already with all co's i am with trying to get me to drive illegal.seriously considering to going back to shuttle driving even tho I HATE slip seating is why I went back otr

    Do you drive outside a 100 mile radius from the terminal you start from?

    Are they referring to:
    There are 5 things that have to be done to get the exemption. The thing most "local" drivers forget is if you go past the 12th hour you need to then start a log book for any portion of your day past the 12th hour.


    (e) Short-haul operations
    (e)(1) 100 air-mile radius driver. A driver is exempt from the requirements of Section 395.8 if:
    (e)(1)(i) The driver operates within a 100 air-mile radius of the normal work reporting location;
    (e)(1)(ii) The driver, except a driver-salesperson, returns to the work reporting location and is released from work within 12 consecutive hours;
    (e)(1)(iii)(A) A property-carrying commercial motor vehicle driver has at least 10 consecutive hours off duty separating each 12 hours on duty;
    (e)(1)(iii)(B) A passenger-carrying commercial motor vehicle driver has at least 8 consecutive hours off duty separating each 12 hours on duty;
    (e)(1)(iv)(A) A property-carrying commercial motor vehicle driver does not exceed 11 hours maximum driving time following 10 consecutive hours off duty; or
    (e)(1)(iv)(B) A passenger-carrying commercial motor vehicle driver does not exceed 10 hours maximum driving time following 8 consecutive hours off duty; and
    (e)(1)(v) The motor carrier that employs the driver maintains and retains for a period of 6 months accurate and true time records showing:
    (e)(1)(v)(A) The time the driver reports for duty each day;
    (e)(1)(v)(B) The total number of hours the driver is on duty each day;
    (e)(1)(v)(C) The time the driver is released from duty each day; and
    (e)(1)(v)(D) The total time for the preceding 7 days in accordance with §395.8(j)(2) for drivers used for the first time or intermittently.

    i am a lot further than 100 mi from terminal-went to SLC UT and on way back to OH-they took load from me in Gary,IN and gave me another load with 130 more mi than my del-i didnt have time to make del-how am i suppossed to get even further??this dispatcher doesnt have a clue what SHE is doing

    I have worked in logs for 24 years and this is illegal!
    They are "thinking" because you are with 100 air mile radius you dont have to log it.
    however for a driver not to log driving they must report to and be released from the same location the previous 5 or 7 days (brain fart).
    If you are an OTR driver you must account for all driving time by logging driving!
    This includes traffic jams etc! There is no way around this!

    You cant use off duty driving to drive in the direction to do anything work related and you must be relieved from all responsibility to perform work!
    Just clearing all possibilities this dispatcher might be telling you!
    Elogs or not all driving time and work must be accounted for!
    Dont do it and if they insist just say lets call dot to clarify and if they say ok then i wont log driving ;) nicest way to handle it but dont be ####y.
    Now off duty driving i had someone at dot office tell a driver and me way wrong!
    I was in shock the guy was saying its ok to use off duty driving because he ran out of hours. So not true!!!

    i ended up on the side of the road on a state route timing out and no one at Continental would even talk to me so I put in my 5 days notice-they keep $500 pay if you dont-this will surely be a BAD next 5 days!

    They are correct as long as you stay within that city limit and do not go out. That time is all shown on duty not driving. When you do leave that cities limit you have to show driving time.

    HE ALSO missed the part about the box. the dude don't do onduty/driving. if the speedo is moving. that box logs driving. the only choice would be pc.
