Avoid L and L Dean, Inc. Fleet Operators for FedEx Custom Critical

    I am an Independent Contractor for FedEx Custom Critical out of Boettler, OH. For seven months, I worked as a Sub-Contractor driving another Independent Contractor/ Owner Operator's registered commercial vehicle and transporting FedEx Custom Critical loads. The Owner Operators Linda and Larry Dean dba L and L Dean, Inc. out of Chardon, OH was stealing money from me. They started manipulating the settlement pay in May. I brung the matter to Linda and Larry Dean's attention that I was aware that their accounting methods were wrong. We had a contractual agreement of 60/40. I agreed to receive the 60% because I was responsible for buying diesel fuel. Linda and Larry agreed to the 40% because the vehicle I was driving they are the owner operators. The settlement pay never added up.


    Within the Month of October 2013, they literally did not pay me for 12 loads. I have the completed bill of ladens. I haven't received payment; therefore, I resigned. The Deans are thieves. Independent Contractors acting as Sub-Contractors should be aware of these crooks.


    I am in the stage of investigating what to do next. I consulted with a Collection Attorney, and he referred me to the Ohio Department of Labor Board. However and as you may well know, the information on the Ohio Department of Labor website specifically and clearly states that I am not eligible to file a complaint as an employee because I was self employed and I worked as an Independent Contractor/ Sub-Contractor. The options I am given is to write letters to Linda and Larry Dean and file consumer complaints before considering legal actions to retrieve the money owed to me.


    I have contacted Linda and Larry Dean dba L and L Dean, Inc. They have not responded and paid me the money that is due to me. However, they have threaten to take measure to attempt to terminate my contract with FedEx Custom Critical. These are very unethical individuals. I advise no one to do business with these crooks.

    P.S. - The Collection Attorney suggested that I go after FedEx Custom Critical for the 12 loads I have not been paid for and for the Fuel Surcharge Linda and Larry was stealing over the past 7 months. I don't know. It seems logical to me to go after the owner operators because I know FedEx Custom Critical paid them and expected the owner operators to pay their drivers. My friend Mike warned me early on this would happen. The Deans had me to pay for minor maintenance expenses out of my pocket. They never reimbursed me for truck wash, replacing blown exterior lights, faxes, etc. I sent receipts for a trip from Kansas City, KS to Birmingham, AL to Cullman, AL to Fremont, CA to Las Vegas, NV to Deadwood, SD. Oh, they claim they have not received the package of original receipts. And YES, I made copies of each and every receipt. I am going to have to contact the Internal Revenue Service and suggest Linda and Larry Dean dba L and L Dean, Inc. be audited this year.

    Just Wondering . . . . Have anyone reading this post had to deal with this situation of running loads and the owner operators refusing to pay you? When I called Larry Dean he threaten me and said he was going to find a way to terminate my contract with FedEx Custom Critical because after arguing with him about my settlement pay I told him to come get his truck. I also informed Linda and Larry Dean plus FedEx Custom Critical Safety and the Contract Coordinator I offered Larry Dean the option of paying me to transport the truck to Chardon, OH. My explanation to FedEx Custom Critical and to the Deans I could no longer run loads for them without him settling his arrears.

    yes i had a situation i went through the state of texas file a wage claim finally got my due took about a year. I sued both the company and the owner op until the state found the op responsible the many different hearings we had over the phone.

    You see, that is why i would not be a subcontractor. No pay for 12 loads? They would get the truck back. Well most of it.
