yes u definitely need to consult an attorney. your company is responsible for you because u got hurt on the job and its the other person responsibility to make you back hole from the accident lost wages, pain and suffering. if you are on workers comp and receiving benefits you are not really suppose to work. and if u think u can work ask your company to put u on light duty. it will protect u and your back. you can go to www.avvo.com its a website that attorneys will answer your questions in real time. good luck and feel better!

I think when you typed "I'll be doing local work...." you answered alot of your own questions - if you had said, "I'll be doing light duty office work..." then its possible that someone would believe that by no fault of your own, you were under duress. That would be a frivilous lawsuit to take a company that generously provided you a job, is paying you comp., to try to squeeze money out of them....

To be honest, if they caused the accident then why not sue the s*** out of them? I mean how often do truck drivers get the chance to get revenge when 9 times out of 10 the truck driver is blamed at fault even though they weren't and 4 wheelers sue truck drivers and/or companies. Might actually turn the statistics which of course will take a long time but its a start with a case that can be reviewed at a later case when another driver has a similar issue. Most companies have their own in house lawyer. Don't see why they couldn't help as long as you were legal, safe and not at fault.

I've just been taking in to your kind replies as i asked for advice but i do have to chime in on 13 double over , you might not understand but nobody wants to sue my company im happy at my company iam speaking of the truck that hit me i an losing wages by doing local work . I dont do heavy lifting and I've never been one to sit and wait so i requested to my doctor to let me keep on driving, as driving isn't much of hard intense back breaking work why sit at home or light dutty ill just sit in my truck and drive ,but with his concern to my injury he requested me to see a chiropractic

think I said go after company that hit him and that is causing him pain. you are not suppose to work while receiving work comp benefits!!! if he want to work he should ask his company to provide light duty. light duty consist of more than office jobs

I mean, its either we buckle down and start trying to take things back instead of letting the law run us over every time even being truckers as a whole. Other wise its sit back and let them keep screwing us and they don't even offer any KY when they do.

Well thats another thing im not getting workmans comp my company is paying me 50$ a day as breakdown pay so thnx you just opened another door i think im getting screwed with out ky here

I was rear ended in my car when traffic stopped on the freeway... Slam dunk, right? Nope! I had a team of (overpaid) Lawyers on it, a year later I walked with ZERO, the scumbags .... er um I mean the Lawyers made tens of thousands.
Get ready to spend 100 or so hours of your time (not counting the commute to Lawyers offices, court, etc). Then have a Lawyer say "sorry but this looks like a dead end", Thats of course AFTER they bill YOUR companies insurance for their time.
