A week ago I filled out my application for HAZMAT and got my fingerprinting taken care of but I have a minor concern. I didn't lie, by any means, on my application but I did answer truthfully due to a technicality. The question I am concerned about is the one concerning a conviction or guilty plea for distribution of controlled substances. I was charged with several felony counts of V.G.C.S.A. (Violation of Georgia Controlled Substance Act) for marijuana sales but entered a First Offenders plea in the case. According to a First Offenders plea I am not a felon nor have I been convicted of a felony offense. I am, however, on state probation for these felony offenses that I have not been convicted of. With First Offenders the judge and my lawyer both explained to me that I am not required to state that I have been convicted of those charges as I technically served an adjudicated sentence. My question is that since my arrest record still shows that I was arrested for these offenses but contains a note stating that I served an adjudicated sentence will that hurt me for the purposes of my background check? I cannot get my record expunged until I am finished with probation. I know that the background check will turn this information up but I did respond honestly within the stipulations of the law. If I pass for my HAZMAT I plan on the TWIC application next but I figured I'd go with the less expensive of the two while I wasn't sure of the outcome.

the tsa check which handles both hazmat and twic card services. takes 30 to 60 days to here anything back. it's a yes or a no. you will get a letter in themail either way in a few weeks. so just relax and don't let it bother you.

they're mainly looking for ties to terrorists. but, like mentioned above. you'll get a letter either yes or no.

You will get an E-mail response quicker , and they also check your Family ties , my wife (at the time) works for TSA , you wouldn't believe the horse crap decisions . A lot more disclosure was needed for me because my wife worked for TSA. I do believe any felony and it will be a negative . I have a record pretty long all due to , adolescence mis judgements. I can say that mine did go thru . One big area that they scrootinize now is any form of rehabilitation. drug/alchohol . its getting out of hand . things that you did 30 years ago can ruin your chance at a good . I was turned down from a great Job $22hr plus all the benies years ago because of a DWI back in 1984 .

If you put it in a week ago, you could probably just call them and ask if its back or not. They look it up by your social. When I called to do the pre questions, the lady said, call us a week after you fingerprint. I did, and they said it came back 4 days after I fingerprinted. I dont know if mine came back quicker due to already having one done on me recently for my conceal carry permit, but it came back quick. Give them a call at the number for the questionare over the phone, and theyll let you know. You dont have to wait for the letter.

I have a felony. Got it about 10 years ago for robbery and passed the backround check with flying colors. Snowwy is right. They look for terrorist kinda stuff.
