Well you see that's the problem with you're theory. DOT can search your truck, they can't open cabinets or get in your personal bag or anything like that but they can search the bunk and have a right to search your cab. Ask ooida. When DOT says I'm going to search your truck you look right at them and say "You don't have my permission but I can't stop you". You don't have the same rights having a CDL as you do in a car. In a car they need probably cause. In a truck all they have to do is say "random inspection" that's how it works.

Bout a year ago a DOT cop was doing insp, right out of the fuel island at the old GIANT truck stop in Jamestown,NM (now a Pilot) went in and told the manager that if this was an allowed practice that I would scratch this stop off my list, I had done this right at the fuel counter with about six deep in drivers, before you knew it, I wasn't the only one complaining, and I have not seen the DOT there since, maybe it helped, who knows.
I guess my question as far as the truck stop goes is this, I understand that it is property owned by a private entity, but honestly, it is open to the public, I have no idea what is really legal, or not, when it comes to these situations.Cetane+ Thanks this. -

in utah, you get a ticket on private property. it's dismissed in court.
i wouldn't think they have the right to harass on private property. without consent. it's not dot regulated property.

in Kentucky they have to have the permission of the land owner, this got me out of a big mess years ago, little city cop pushing his weight and it was DOT that helped me out and explained the law. needless to say DOT keeped me out of jail that night.

i think a good question to be asking the police, is if they have permission to be on the private property, harrasing the patrons.

I was parked at Jim's Truck Stop off Walden Avenue in Buffalo, NY one day (it's a dump - park elsewhere like the T/A or Flying J in Pembroke) and NYDOT was stopping trucks as they pulled in to the parking lot. But it was technically on K-Mart property as the TS is beside the K-Mart, it's a shared entrance with a laneway that leads to the truck parking. This has been the only time I've personally seen DOT stopping trucks at or directly near a TS thus far.

I've also heard about him hanging out near Sapp Bros in Peru and Pilot in Princeton as well. -
I can seeing getting pulled over in the middle of your break. Well a cop told me to move. He would laugh at you as he wrote a ticket. -
