I've run mine 60 miles a few times with 34 ton on the trailer . Haven't hurt anything ... ( I'm not prefect....).

Most states let you reweigh an overwieght axle ( not hazmat).

Get a good local lawyer and fight the ticket. At least you can get it knocked down to a reasonable $ amount.

 

It doesn't matter that he forgot to flip the valve, or that flipping it solved over weight issue. At the time he pulled on the scale he legally was over on axle 4 period. I have seen many triaxle dump trucks in the same spot left the pusher up after a turn. Its overweight that is why I sold my dump trucks, they allow you 40 feet after a turn to get the pusher down. It sucks and I'm not being smart but you were over when you pulled on scales, and had run that way a few miles. I'm just speaking from experience and the fine is ridiculous I agree. I just can't see anybody loosening the noose or they never did for us.

 

I don't live far from that particular coop. I will talk to a couple of other drivers and get back to you about a lawyer. In the future I would recommend going around that scale. I can tell you the route. Just a FYI: the state police academy is off of exit 88 on I-55 and that is the closest scale.

 

I have been to the court for over weight. $4k ticket that got reduced to $1500.
