they can do anything they want
is it right fair or moral?
NO -
Sure, but the driver should know what is on his DAC before they applied.
Id be surprised if a company would not tell them why they did not get the job. Unless they were afraid of legal repercussions, why not tell them why? -
That's what I told him. I mentioned that the DAC report is free to him yearly and he should always take advantage of that. He is telling me that they would not disclose what was on the DAC report or within what reasoning. I simply told him if they are paying to send him home he needs to do whatever he can to have that DAC report waiting on him when he gets there. Spend the few extra bucks to have it today. But I feel he didn't give me ALL his information when I took his application.

If the potential employee knew that he had some issues in the past that could have possibly been found, he should have had his DAC report sent to him first before he applied to any company for employment. You can send for one free DAC report per year. He knows what is on there. -
Any potential employer has the right of refusal to any potential employee. For any reason.
He was not owed an explanation, of any kind.otherhalftw Thanks this. -
That's typical the way they do it because all the cost associated with checking one's background. DAC they can subscribe or pay per view. Just like you read on this forum drivers might apply to several places and might not show up for their orientation. A driver should be familiar with his/her's background and bring anything forward on the application. That is suppose to cover the prehire end and works in most situations. Then when the driver does show up for orientation is when the company gets serious and starts the mandatory background checking.
Then you get a driver like this that is unaware of his DAC. He either had an idea but failed to check, was trying to hide something or he could of left a vindictive lying company. It happens all the time. A driver needs to keep up with his own DAC and take advantage of the yearly free report. Had he seen it earlier he could of disputed it if it was vindictive then he wouldn't of been in the situation he was in. If he wasn't honest on his application and finally got caught then he has no complaint. -
You have no idea how many drivers I go through and I ask questions about accidents, background, work history. I would say 90% are honest with me. But there are a few that say "oh no, I'm clean" I had one driver tell me that he had a clean record, it came back that he had three counts of child molestation on his record.

As i tell ALL. Go to Hireright.com. Request copy of your DAC for free. Takes approx. 3 weeks to get. Then if something not right dispute it . Even tho your copies will show all past reported.(Cause some companies don't report to DAC) ALL info weather good or bad will be removed after 7 years.

in califorina,if they tell you they didn't hire you because of your DAC,they must give you a copy of said DAC report.
