    Ok MM, I have been going over Easement/Encumbrances according to Texas Real Estate Principals I & II by Rodriguez, Terrell, Stockton, and Adams (all Texas authors btw), published by Huber ETC Books.


    Texas encumbrances are similar in nature to CA.
    • Your land has an Easement in Gross which means your land (the location of the easement) is given in easement to allow access such as the telephone company.
    • This creates a benefit to those who don't own the land and makes your land the Servient Tenement permitting the utility access and use.
    • An easement does not specify a special area for a right-of-way is also valid
    You as the property owner could give the right to cross and not limit how or where to cross. This would be known as an Unlocated Easement.

    One interesting thing about Texas Law applies to surface water rights. Under state law, all surface water flowing in every river, stream, lake, including floodwater, storm water, and accumulated rainwater, belongs to the state of Texas. This ownership covers all water flowing into the state too.

    I'd say there are more good then bad, but as of lately the bad is showing in those who really aren't what they appear due to stress and all of the other factors caused by today's problems. We all, atleast most of us need to start taking a stand soon, because I am sure no one wants to pay any more for fuel then what we are now. 4.25 is sure to happen and that is going to kill a lot of business.

    i know and i thank you for the great job you do here

    any talks of layoff's and cut backs where you work???

    fuel is a large part of why we are only o/o's now

    We are hurting up here too......Everyone is running around, cussing and all mad, we need to focus our energy on doing something about it rather then wasting this energy on yelling, is what I tell them.

    It's got to come to a halt here............####! How high can this go?
